Ieslodzīto tiesības uz veselības aprūpi

Abstract

Bakalaura darba temats ir “Ieslodzīto tiesības uz veselības aprūpi”. Ieslodzīto veselības aprūpē pastāv atšķirības starp vēlamo situāciju un to, kāda tā ir patiesībā. Lai gan gadu gaitā veikta virkne dažādu uzlabojumu, atsevišķas problēmas un nepilnības nav novērstas un pastāv joprojām. Tā autoritatīvu institūciju, piemēram, Latvijas Republikas Tiesībsarga, Eiropas Padomes Komitejas spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanai, atzinumos tiek iekļautas norādes par ārstniecības personāla trūkumu, medikamentu un medicīnas preču nenodrošināšanu ieslodzītajiem, izsniedzamā uztura daudzuma nepietiekamību, kā arī vairākkārt konstatēti pārkāpumi attiecībā uz stomatoloģiskās palīdzības pieejamību. Bakalaura darba mērķis - noskaidrot personas tiesību uz veselību nodrošināšanas nepilnības un problēmas Latvijas Republikas ieslodzījuma vietās, kā arī normatīvajā regulējumā un sniegt ieteikumus esošās situācijas uzlabošanai. Šī mērķa sasniegšanai tika izvirzīti pieci uzdevumi: 1) noskaidrot tiesību uz veselību saturu; 2) iepazīties ar Latvijas Republikas normatīvajiem aktiem un starptautiskajiem dokumentiem, kas nosaka vispārējās personas tiesības uz veselības aprūpi; 3) analizēt Latvijas normatīvo regulējumu un praksi attiecībā uz veselības aprūpes nodrošināšanu brīvības atņemšanas iestādēs; 4) apkopot un izanalizēt ieslodzīto aptaujāšanas ietvaros iegūtos rezultātus; 5) apskatīt Čehijas, Igaunijas, Somijas un Vācijas ieslodzījuma vietās esošo personu tiesības uz veselību. Bakalaura darba izstrādes rezultātā autore, balstoties uz brīvības atņemšanas iestādēs veiktajām ieslodzīto aptaujām, starptautisko un nacionālo institūciju atzinumiem, Latvijas Republikas, kā arī citu Eiropas valstu normatīvo regulējumu un apstākļiem ieslodzījuma vietās, sniegusi ieteikumus prakses nepilnību novēršanai un normatīvā regulējuma uzlabošanai. The theme of the bachelor's paper is “Prisoner's right to health care”. In terms of health care for prisoners there are differences between the desired and actual situation. Although a number of different improvements have been made over the years, certain problems and weaknesses have not been addressed and still exist. Authoritative institutions such as the Ombudsman of the Republic of Latvia, the Council of Europe Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment include references to the lack of medical staff, the lack of provision of medicine and medical supplies to prisoners, the inadequacy of the amount of food to be provided, and repeated violations towards access to dental care. The objective of the bachelor's paper is to ascertain the shortcomings and problems of the person's right to health in the prisons of the Republic of Latvia, as well as in the regulatory framework and make recommendations for improving the current situation. To achieve this goal, five tasks were set: 1) to determine the content of the right to health; 2) to get acquainted with the regulatory enactments of the Republic of Latvia and international documents, which determine person's general rights to health care; 3) to analyze Latvian normative regulation and practice regarding provision of health care in institutions for deprivation of liberty; 4) to collect and analyze the results obtained during the survey; 5) to look at the prisoner's rights to health care in the Czech, Estonian, Finnish and German prisons. As a result of the development of the bachelor's paper, the author, on the basis of prison inmates' inquiries, opinions of international and national institutions, legislation of the Republic of Latvia, as well as other European countries, and conditions in prisons, has provided recommendations for remedying the practical weaknesses and improving the regulatory framework.
