Atbilstoši tiesneša ētikas normām tiesnesim jāpilda tiesu varas uzliktie pienākumi objektīvi un taisnīgi, līdz ar to nozīmīga ir tiesas un tiesnešu neatkarība no procesa dalībniekiem jeb personiskā neatkarība. Tiesneša objektivitāte un neitralitāte neaprobežojas tikai ar likumā uzskaitītajiem apstākļiem, kas ir pamats tiesneša atstatīšanai vai noraidīšanai, bet, izvērtējot objektivitāti, var ietvert arī jebkurus citus apstākļus, kas pamatoti var novest pie tiesneša objektivitātes un neitralitātes trūkuma. Darba mērķis ir analizēt tiesneša ētikas regulējumu un normatīvos aktus par tiesneša atstatīšanos un noraidījumu civillietās, kā arī apskatīt gadījumus, ko normatīvie akti neregulē, bet pēc ētikas normām tiesnesim būtu nepieciešams apsvērt sevis atstatīšanas iespējamību. Darba izstrādes gaitā autore pēta tiesu praksi konkrētā tiesā trīs gadu laika periodā par tiesneša atstatīšanās un noraidījuma gadījumiem un nonāk pie secinājuma, ka likums pilnībā nenovērš interešu konflikta situācijas, ko veicina, piemēram, sociālo tīklu aktualitātes pieaugums, tādēļ, kā efektīvs objektivitātes novērtēšanas līdzeklis, ir augsta tiesneša ētiskā apziņa, saprātīga vērotāja tests, tiesnešu pašpārvaldes institūciju darbība un tiesu prakse šajos jautājumos. According to the ethical principles for judges, the judge must perform the duties of the judiciary impartially and fairly, therefore the independence of the courts and judges from the participants in the process or personal independence is essential. The impartiality and neutrality of the judge is not limited to the circumstances listed in the law, which is the basis for the reinstatement or rejection of the judge, but, when assessing objectivity, may include any other circumstances that may reasonably lead to the loss of impartiality and neutrality of the judge. The aim of the work is to analyze the ethics of the judge and the normative acts on a refusal of the judge and refusal in civil law, as well as to look at cases that are not regulated by law, but according to ethical standards, the judge should consider the possibility of recusal. During paper development the author has studied the case law of a particular court over the course of three years on the recusal of a judge and comes to the conclusion that the law does not completely include all kinds of conflicts of interest situations promoted by, for example, the increase of the relevance of social networks, therefore, effective evaluation of objectivity is ethical awareness of the judge, reasonable observer test, the activities of the judicial self-governing institutions and judicial practice in these matters.
