Abstract

Starptautisko investīciju tiesību attīstība kopš 20.gadsimta otrās puses ir ļoti cieši saistīta tieši ar starptautiskajām paražām, kas ir bijušas gan par pamatu, lai izveidotos investīciju tiesībās noteiktie vispāratzītie noteikumi, gan arī ir attīstījušās un pilnveidojušās investīciju tiesību tvērumā. Mūsdienās gan ir vērojami problēmjautājumi, kas skar starptautisko investīciju tiesību saikni ar Eiropas Savienības tiesībām. Tieši tāpēc autors šī pētījuma rezultātā pierādīs, ka starptautisko paražu ietekme starptautiskajās investīciju tiesībās kopumā tikai pieaug. Darbs sastāv no 3 nodaļām, kurās ir aprakstītas starptautiskās paražas, investīciju tiesības un staptautisko paražu ietekme uz mūsdienu investīciju tiesībām.

The development of international investment law since the second half of 20th century is substantially connected with international customary law, which have been not only the basis of the foundation of internationally accepted rules in investment law, but also have improved and evolved in the scope of investment law. Nowadays there are problematic aspects, which concerns the relationship of investment law with European Union law. This is the reason, why author will prove, that international custom influence in international investment law is getting only more relevant. This thesis consists from 3 chapters, where there are described international customs, investment law and the influence of international customs on the contemporary investment law.
