Tiesnesis, tostarp Satversmes tiesas tiesnesis, visupirms ir cilvēks kā bioloģiska būtne un var iegūt vairākus sociālos statusus, kas var būt savstarpēji pretrunīgi. Juridiskās metodes ierobežo Satversmes tiesas tiesneša rīcību, taču tās “nenosedz visu spēles laukumu”. Zināmu Satversmes tiesas tiesneša rīcības brīvību paredz, piemēram, teleoloģiskā interpretācijas apakšmetode un tiesību normu augstākā kritika. Tas novērojams arī Satversmes tiesas praksē. Pētījuma rezultātā noskaidrots, ka Satversmes tiesas tiesneša sociālo statusu veidojošās normas, jo īpaši morālā autonomija un sociālā kompetence, nodrošina, ka Satversmes tiesas tiesnesis var realizēt tiesībās balstītu taisnīgumu arī tad, ja juridiskās metodes neparedz nepārprotami skaidru tiesisko noregulējumu konkrētai faktiskai situācijai. A judge (incl. a judge at the Constitutional Court) is primarily a human being and may embody several potentially contradictory social statuses. Legal methods limit the discretion of a judge of the Constitutional Court; however, they do not restrict it completely. For example, teleological interpretation and judicial review leaves the judge with some level of discretion. It manifests in the case law of the Constitutional Court. In the end of this study, it was concluded that the norms establishing the social status of a judge of the Constitutional Court, especially moral autonomy and social competence, ensure that a judge of the Constitutional Court may protect the law-based justice even if the legal methods do not prescribe explicit regulations for the situation based on the facts at hand.
