Progresīvās brīvības atņemšanas soda izpildes sistēmas īstenošana Latvijas ieslodzījuma vietās

Abstract

Bakalaura darba temats ir „Progresīvās brīvības atņemšanas soda izpildes sistēmas īstenošana Latvijas ieslodzījuma vietās”. Brīvības atņemšanas soda izpilde Latvijā notiek atbilstoši soda progresīvās izpildes principam, kas izpaužas soda izciešanas režīma pakāpeniskā mīkstināšanā vai pastiprināšanā un notiesātā pārvietošanā no viena veida cietuma uz cita veida cietumu, balstoties uz izciesto soda daļu un notiesātās personas uzvedību. Bakalaura darba mērķis ir izpētīt brīvības atņemšanas soda izpildes vēsturisko attīstību, brīvības atņemšanas soda jēdziena saturu, progresīvās brīvības atņemšanas soda izpildes sistēmas īstenošanu Latvijas ieslodzījuma vietās, kā arī salīdzināt brīvības atņemšanas soda izpildes tiesisko regulējumu Latvijā ar regulējumu citās valstīs. Lai sasniegtu bakalaura darba mērķus jānoskaidro, kas ir brīvības atņemšana un kāds ir šī soda saturs, jānoskaidro, kā ir attīstījusies brīvības atņemšanas soda izpilde, jānoskaidro, kā Latvijā tiek piemērota un īstenota progresīvā brīvības atņemšanas soda izpildes sistēma un jānoskaidro atšķirības starp brīvības atņemšanas soda izpildes regulējumu Latvijā un ārvalstīs. Pētījuma rezultātā darba autors nonāca pie secinājuma, ka ir nepieciešams veikt izmaiņas normatīvajā regulējumā, lai nodrošinātu plašāku notiesāto kustību progresīvās brīvības atņemšanas soda izpildes sistēmas ietvaros.

The subject of Bachelor’s thesis is implementation of progressive imprisonment penal system in Latvian prisons. Execution of imprisonment in Latvia is carried out according to the principle of progressive execution of sentence, which manifests in gradual mitigation or enhancing of the sentence serving regime and transfer of convicted persons from a prison of one type to a prison of another type, based on portion of the sentence served and the behaviour of the convicted person. The aim of this Bachelor’s thesis is to investigate historical development of the execution of imprisonment sentence, content of the notion of deprivation of liberty, implementation of progressive imprisonment penal system in Latvian prisons, as well as to compere legal framework of execution of imprisonment sentence in Latvia with legal framework in other countries. In order to achieve the aim of Bachelor’s thesis it is necessary to find out, what is deprivation of liberty and content of this sentence, how the execution of imprisonment has developed, how progressive imprisonment penal system is applied and implemented in Latvia, what are the differences between regulation of execution of imprisonment sentence in Latvia and other countries. As a result of the research, the author of this Bachelor’s thesis came to a conclusion, that it is necessary to make changes to the legal framework in order to ensure wider movement of convicted persons within the framework of the progressive imprisonment execution system.
