Autortiesību pārkāpuma raksturojums attiecībā uz fotogrāfijā attēloto personu

Abstract

Bakalaura darba nosaukums: “Autortiesību pārkāpumu raksturojums attiecībā uz fotogrāfijā attēloto personu”. Palielinoties personu iespējām radīt fotogrāfiskos darbus, dabiski paaugstinās pārkāpumu skaits, kas saistīts ar fotogrāfisko darbu prettiesisko izmantošanu un fotogrāfijās attēloto personu tiesību aizskārumiem. Darba mērķis – konstatēt fiziskās personas tiesību aizsardzības iespējas gadījumā, kad aizskartā persona nav autortiesību subjekts vai izpildītājs blakustiesību izpratnē, ja tiek pārkāptas personas tiesības saistībā ar viņas attēla publiskošanu. Darbā tiek apskatītas autortiesības saistībā ar fotogrāfiju jeb fotogrāfisku darbu, fotogrāfijas prettiesiskā izmantošana un fotogrāfijā attēlotās personas tiesību aizskārums no teorētiskā un prakses viedokļa. Rezultāts - Fotogrāfijā attēlotā persona, ja tā nav autortiesību subjekts vai izpildītājs blakustiesību izpratnē, netiek pietiekoši nodrošināta ar piemērotām aizsardzības garantijām Autortiesību likuma ietvaros.

Bachelor thesis title: “Characteristics of the copyright infringement regarding the person shown in the photograph”. Increasing opportunities for people to create photographic works, naturally increases the number of violations that involve the illegal use of photographic works and violations of the rights of persons represented in photographs. The aim of the work - to establish the possibilities of protection of the rights of person if a person's rights regarding the disclosure of her image are violated, in cases where the injured person is not the copyright holder or performer in the context of related rights. The result - The person that is displayed in the photo, if it is not the copyright owner or performer in context of related rights, is not sufficiently secured or provided with suitable protection guarantees by adequate safeguards under the Copyright law.
