1969. gada Vīnes konvencija par starptautisko līgumu tiesībām ir ANO STK darba lielākais sasniegums, kuras sastādīšanas mērķis bija starptautisko tiesību paražu normu kodifikācija un starptautisko tiesību progresīva attīstība. Konvencijas 18. pants nosaka pienākumu nevērsties pret līguma objektu un mērķi pirms līguma stāšanās spēkā. Šim pantam piemīt specifisks piemērošanas laiks, kas valstīm jāievēro, lai nodrošinātu veiksmīgu līguma spēkā stāšanos un izpildi. Lai arī praksē bieži sastopama situācija, kad 18. pants ir piemērojams, tas nekad nav ticis piemērots, kā arī tiesībzinātnieku viedokļi par šī panta pienākumu ir nekonsekventi. Darba mērķis ir pētīt 18. pantu no dažādiem tiesiskajiem aspektiem, apzināt pantā regulētā priekšmeta nepieciešamību un noskaidrot tā problemātiskās piemērošanas iemeslus. Panta kontekstā tiks pētīts arī labas ticības princips un estoppel doktrīna. Lai sasniegtu darba mērķi tiks analizēti panta travaux preparatoires, panta komentāri, ar to saistītā doktrīna un starptautisko tiesību prakse. Darba temata izvēle tiek pamatota ar argumentu, ka jebkurš posms, kas veicina starptautisko līgumattiecību veidošanas ir vienlīdz nozīmīgs. 1969 Vienna Convention on the Law of Treaties is the greatest achievement of UN ILC work, whose goal was codification of existing international customary law and progressive developement of international law. Article 18 of the Convention states the obligation not to defeat the object and purpose of a treaty prior to its entry into force. This article holds a specific time of application and in accordance for successfull entry into force of the treaty states have to implement it. Despite that there are often situations when the article is applicable, it has never been applied. Opinions of the law scholars on the matter of the article obligation are inconsistent. The goal of the study is to examine article 18 from various legal aspects, to appraise necessity of the object of the article and to ascertain reasons of its application problems. In the context of the article principle of good faith and estoppel doctrine also will be studied. To reach the goal of the study author will analyse article travaux preparatoires, commentaries of the article, doctrine and practise of international law. The preference of the subject of the study is based upon the argument, that every stage which promotes interational treaty-based relations is equally important.
