Maģistra darbā aplūkota nolēmumu konstitucionālā sūdzība kā iespējams konstitucionālo tiesību aizsardzības mehānisms Latvijā, paplašinot līdzšinējās indivīdam pieejamās iespējas. Darba mērķis ir izpētīt nolēmumu konstitucionālo sūdzību kā iespējami efektīvu personas pamattiesību aizsardzības līdzekli, pievēršot uzmanību arī potenciālajiem riskiem. Darba ietvaros aplūkots nolēmumu konstitucionālās sūdzības institūts, analizējot to atbilstoši Satversmes tiesas kompetenču paplašināšanas kritērijiem. Analizējot citu valstu pieredzi, izsvērti ieguvumi un problēmas, kas varētu rasties šāda institūta ieviešanas rezultātā. Darbā iegūtie rezultāti: noteikti trūkumi tiesu darbā cilvēka pamattiesību kontekstā, izvērtēta citu valstu pieredze ar paplašinātu konstitucionālo sūdzību, piedāvāts nolēmumu konstitucionālās sūdzības tvērums un regulējums, gūta atziņa, ka nolēmumu konstitucionālā sūdzība atbilst Satversmes tiesas kompetenču paplašināšanas kritērijiem, un izvirzīti priekšlikumi, lai preventīvi novērstu iespējamos ar institūta ieviešanu saistītos riskus. Master thesis examines the constitutional complaint against court decisions (Urteilsbeschwerde) as a possible mechanism of protecting the fundamental rights in Latvia, widening the current possibilities available for an individual. The aim of the master thesis is to study the constitutional complaint against court decisions as a possibly effective remedy for the protection of individual’s fundamental rights in Latvia by taking in consideration also the possible risks. The master thesis will examine the constitutional complaint against court decisions in accordance to both the criteria on widening of the competences of the Constitutional Court and the current regulations of the Constitutional Court Proceedings. In addition to that, the benefits and risks of this institute, analysed through the experience of other states, are taken in consideration. The results of the research: identified problems regarding the protection of fundamental rights in the work of the courts; analysed experience of the other states with a widened constitutional complaint; proposed scope and rules of the court decision constitutional complaint. Likewise, the author concludes that the constitutional complaint against court decisions meets the criteria of widening the competences of the Constitutional Court and has made proposals how to prevent problems which could arise from the introduction of the court decision constitutional complaint.
