Bērnu ar speciālajām vajadzībām tiesību uz izglītību nodrošināšana Latvijā

Abstract

Bakalaura darba mērķis ir izpētīt tiesību uz izglītību nodrošināšanu Latvijā bērniem ar speciālajām vajadzībām un, pamatojoties uz konstatētajām problēmām, izstrādāt priekšlikumus. Lai sasniegtu šo mērķi, autore pētīja starptautiskos un nacionālos normatīvos aktus, iepazinās ar pētījumiem par iekļaujošās izglītības jautājumiem, kā arī analizēja valsts un pašvaldību kompetenci šo tiesību nodrošināšanā. Darbā ir 49 lappuses, t.sk. pirmajā nodaļā ir aplūkots jēdziena “bērns ar speciālajām vajadzībām” skaidrojums, kā arī aprakstīti jautājumi par tiesībām uz izglītību un iekļaujošās izglītības pamatprincipi bērnu ar speciālajām vajadzībām kontekstā. Otrajā nodaļā autore analizē valsts, t.sk. pašvaldību, atbildību attiecībā uz pētāmo jautājumu, kā arī aprakstīta vecāku atbildība. Savukārt trešajā nodaļā autore aplūko speciālās izglītības programmu īstenošanu vispārējās un speciālās izglītības iestādēs. Darbā autore secina, ka izglītības sistēma Latvijā pakāpeniski tiek pielāgota iekļaujošās izglītības principiem. Vienlaikus prakse norāda uz ikdienā sastopamiem problēmgadījumiem, kā risinājumā tiek iesaistītas valsts un pašvaldību iestādes, kā arī galējas nepieciešamības gadījumos – tiesas. Šo gadījumu risināšanā tiek izvērtētas un ņemtas vērā bērna vislabākās intereses. Vienlaikus autore secina, ka praksē var nākties risināt kolīzijas starp bērna ar speciālajām vajadzībām un bērnu, kuriem šādu vajadzību nav, interesēm. The aim of the bachelors work is to analyze the situation in ensuring the right to education for children with special needs and to develop suggestions to solve identified problems. In order to reach this goal, the author studied national and international legislation, research on topics of inclusive education and analyzed state and municipal level responsibilities in provision of right to education. The work consists of three main sections and is 49 pages long. The first section includes discussion on terminology regarding children with special needs and inclusive education, as well as analysis of national and international legislation on the research topic. In the second section the author analyzes national and municipal level responsibilities regarding the topic. The third section covers the situation in implementation of special education programs in the level of education institutions. The author concludes, that the education system in Latvia is being gradually adjusted to the principles of inclusive education. Meanwhile, there are everyday problem cases where state and municipal level institutions need to be involved, as well as courts in some of extreme cases. The problem cases mainly arise due to prejudice in society and not due to mistakes in applying the legislation. In these cases, the best interests of children are assessed and implemented. At the same time, the author concludes that in everyday situations there may be need to solve collisions between interests of children with special needs and children without them.
