Tiesneša darbības regulējums ētikas un tiesību normas

Abstract

Bakalaura darba mērķis ir izpētīt tiesneša darbības regulējumu ētikas un tiesību normās. Darbā ir izvirzīti uzdevumi analizēt tiesu varu valsti, sīkāk apskatīt Latvijas tiesnešu ētikas kodeksa normas un tiesnešu darbības regulējumu tiesību normās. Tiesneši ir reālie tiesas varas īstenotāji valstī. No tiesnešu profesionalitātes un ētiskas normu izpratnes ir atkarīgi gan visas sabiedrības, gan katra indivīda tiesību un likumisko interešu aizsardzība. Būtiski ir radīt situāciju, kad sabiedrības uzticība tiesai ir tik liela, ka nerodas šaubas, ka Latvija ir tiesiska valsts. Tiesnesis ir amats, kas prasa augstas profesionālās zināšanas. Tikpat svarīgi tiesnešiem ir ievērot ētikas normas prasības un tiesas realizēšanas principus. To visu var vērtēt izejot tikai no tā, ka Latvija ir demokrātiska un tiesiska valsts. Darbā tiek pētīta tiesneša darbības regulējums ētikas un tiesību normās, par problemātisko aspektu izvirzot ētikas un tiesību normu būtisko nozīmi tiesas darbā, un šo regulējumu līdzāspastāvēšanu. Darbā tiek secināts, ka tiesas neatkarībai nozīme būs tikai tad, ja pati tiesa respektēs un ievēros, gan ētikas normas, gan savas darbības tiesisko regulējumu. The purpose of the this work is to investigate the regulation of the judge's work in ethical and legal norms. The task is to analyze the state of the judiciary, to review the norms of the Ethics Code of Latvian judges and the regulation of the activities of judges in legal norms. The judges are the real enforcement of the state. The protection of judges' professionalism and ethical standards depends on the protection of the rights and legitimate interests of the entire society as well as of each individual. It is essential to create a situation where the public trust in the court is so powerfull that should be no doubt that Latvia is a lawful state. A judge is a position, when requiring person with high level of professional knowledge. It is equally important for judges to comply with the ethical requirements and the principles of the realization of the law. All this can be judged on the basis only of the fact that Latvia is a democratic and justful state. The work deals with the regulation of the judge's work in ethical and legal norms, placing the problematic aspect of the essential role of ethics and legal norms in the work of the court, and the coexistence of these regulations. I was concluded that the independence of the court will be important only if the court itself respects and observes both ethical norms and the legal regulation of its activities.
