Abstract

Bakalaura darba tēma ir ''Godprātība kā fiziskās personas maksātnespējas procesa elements un tās izvērtēšana praksē’’. Vērtējot tiesību normu kopumu, var izdarīt secinājumu, ka maksātnespējas process var tikt piemērots tikai godprātīgai personai, kas kaut kāda iemesla dēļ ir nonākusi finansiālās grūtībās. Diemžēl, ir gadījumi, kad parādnieks maksātnespējas procesu izmanto negodprātīgi. Negod-prātība var izpausties gan pirms procesa, gan procesa laikā. Darba autores uzdevums ir censties noskaidrot iespējamos iemeslus šādai rīcībai, meklēt ar to saistītos problēmjautājumus, un mēģināt rast risinājumu. Darba uzdevums ir analizēt fiziskas personas maksātnespējas procesa reglamentējošos normatīvos aktus, tiesu praksi, kā arī citu autoru izteiktos viedok-ļus.

A bachelor work theme is ‘’Honesty as an element of the insolvency process of a natural person and its evaluation in practice’'. The law states that the insolvency process can be applied only to a good per-son who for some reason has been in financial difficulty. Unfortunately, there are cases when the debtor uses the insolvency process badly. Non-conscience can take place both before and during the process. The task of the author is to try to find out the possible reasons for such an action, to look for the related issues and try to find a solution. The aim of the thesis is to identify the issues of the person's integrity before the process and during the process, studying the court practice and finding reasons for the debtor's dishonesty during the process, and make suggestions for their solu-tion. The task of the thesis is to analyze the normative acts of the natural person's insolvency process, court practice, as well as the opinions expressed by other au-thors.
