Atbilstoši nacionālajam normatīvajam regulējumam rīcībspēja piemīt jebkurai pilngadīgai personai un to var ierobežot tikai likumā noteiktos gadījumos. Kopš 2013.gada 1.janvāra tika veiktas vērienīgas izmaiņas normatīvajā regulējumā, aizstājot pilnīgu rīcībspējas atņemšanu ar tās ierobežošanu mantiskajās attiecībās. Maģistra darba mērķis ir izpētīt pilngadīgu fizisko personu rīcībspējas ierobežošanas un aizgādnības nodibināšanas nacionālo un starptautisko tiesību normatīvo regulējumu, tiesu praksi un alternatīvas personu tiesību un interešu aizsardzībā šajā jomā, lai aktualizētu šajā tiesību institūtā esošo problemātiku un sniegtu priekšlikumus tā uzlabošanai. Maģistra darbā apskatīta rīcībspējas institūta attīstība, tās jēdziens un sastāvdaļas. Pievērsta uzmanība rīcībspējas ierobežošanas tiesiskajiem pamatiem, analizēta tiesu prakse, saskatot tajā esošās problēmas tiesību normu piemērošanā, kā arī izpētīti alternatīvi mehānismi rīcībspējas ierobežošanai. Maģistra darba rezultātā secināts, ka Latvijā nepastāv būtisku problēmu tiesību normu piemērošanā, bet pastāv problēmas tiesību normu pareizā piemērošanā. Maģistra darbā arī konstatēts, ka ārzemēs šobrīd tiek izmantoti alternatīvi mehānismi rīcībspējas ierobežošanai un ka vismaz vienu no tiem veiksmīgi varētu ieviest Latvijā. In accordance with the national legislation, legal capacity exists for any adult person and may be restricted only in cases provided by law. Since January 1, 2013, significant changes were made to the legislation, replacing the complete deprivation of legal capacity with its limitation in property relations. The aim of the master's thesis is to study the legal framework of national and international law, case law and alternatives to the protection of the rights and interests of persons in this area in order to update the problems existing in this subject and to make proposals it's improvement. The Master's thesis deals with the development of the legal capacity of act, its concept and its components. Attention is paid to the legal basis for limitation of legal capacity, the case law has been analyzed, pointing out the problems of applying the legal norms. Alternative mechanisms for limitation of capacity has been investigated. As a result of the master's thesis, author has concluded that there is no significant problems in the application of legal norms in Latvia, but there are problems in the correct application of legal norms. The Master's thesis also states that alternative mechanisms for limiting capacity are currently being used abroad and that at least one of them could successfully be implemented in Latvia.
