Juridiskas personas maksātnespējas process ir tiesiska rakstura pasākumu kopums, kura ietvaros no parādnieka mantas tiek segti kreditoru prasījumi, lai veicinātu parādnieka saistību izpildi. Parādniekam tiek piemērots juridiskās personas maksātnespējas process, ja ir kāda no juridiskās personas maksātnespējas procesa pazīmēm, šo pazīmju galvenais kritērijs ir maksājuma saistību nepildīšana, jeb maksāšanas kritērijs. Maksātnespējas procesa piemērošanai pietiek, ja tiek konstatēta kaut viena no likumā noteiktajām maksātnespējas pazīmēm. Maģistra darba mērķis ir izpētīt un analizēt maksātnespējas procesa pazīmju būtību un to nozīmi maksātnespējas konstatēšanā, un to, kā Maksātnespējas likumā 57. pantā minētās pazīmes tiek interpretētas un piemērotas iesniedzot juridiskās personas maskātnespējas procesa pieteikumus tiesā. Kā viens no uzdevumiem tika izvirzīts izvērtēt esošā normatīvā regulējuma efektivitāti un lietderību, pasludinot juridisku personu maksātnespēju. Kā arī salīdzināt Latvijas juridisku personu maksātnespējas procesa normatīvo regulējumu ar citām valstīm. Analizējot judikatūru un esošo normatīvo regulējumu autore secināja, ka būtiska nozīme maksātnespējas konstatēšanā un palsudināšanā ir tiesību normu pareizai un precīzai interpretācijai un piemērošanai, procesuālas kļūdas var iniciēt nepareizu un neefektīvu rezultātu. Interpretējot un piemērojot Maksātnespējas likumā noteiktās tiesību normas, tās ir jāskata kopsakarībā ar likuma mērķi, uzdevumiem un tiesiskajiem principiem. The legal person's insolvency process is a set of legal measures, in which the claims of creditors are paid from the debtor's property in order to facilitate the fulfillment of the debtor's obligations. The insolvency of the legal person is applied to the debtor, if there is any signs of insolvency of the legal person, the main criterion for these characteristics is the failure to fulfill payment obligations, or the payment criterion. It is enough to apply insolvency proceedings if one of the statutory insolvency grounds is detected. The aim of the master is to investigate and analyze the essence of the features of the insolvency process and their significance in establishing insolvency and how the features referred to in Article 57 of the Insolvency Law are interpreted and applied when filing legal entity suits for insolvency proceedings in court. One of the tasks was to assess the effectiveness and usefulness of the existing regulatory framework by declaring insolvency of legal persons. Also, compare the legal regulation of the insolvency process of legal persons with other countries. When analyzing the case law and the existing regulatory framework, the author concluded that the correct and accurate interpretation and application of legal norms in the determination and suppression of insolvency is important, procedural errors can trigger incorrect and ineffective outcomes. When interpreting and applying the legal norms established in the Insolvency Law, they must be read in conjunction with the purpose, tasks and legal principles of the law.
