Cietušā izpratne kriminālprocesā
Zusammenfassung
Latvijas krimināltiesību politikā noziedzīgā nodarījumā cietušās personas vajadzības tiek pakārtotas likumpārkāpēju sodīšanas funkcijai. Maģistra darba mērķis ir atklāt cietušās personas lomu un nozīmi kriminālprocesa ietvaros, pētot jēdziena “cietušais” izpratni un saturu, kā arī caurlūkojot cietušā tiesiskā statusa un tiesību normatīvo regulējumu. Pētījuma ietvaros autore pievēršas nozīmīgāko cietušā tiesību izpētei un analīzei, piedāvājot iespējamus risinājumus uz praksē un normatīvajā regulējumā atklātajiem problēmjautājumiem. Līdztekus autore rosina veikt plašākus pētījumus atsevišķu procesuālo un materiāltiesisko garantiju precizēšanas vai paplašināšanas nepieciešamībai. The needs of a victim of a criminal offense in Latvian criminal justice policy are subordinated to the state’s punishment function of offenders. The aim of the Master's thesis is to reveal the role and importance of the victim in the criminal process by studying the understanding and content of the term “victim”, as well as by reviewing the legal regulation of the victim's legal status and rights. Within the framework of the research, the author focuses on researching and analyzing the major rights of victims, offering possible solutions to the issues identified in practice and in the regulatory framework. In addition, the author encourages to more extensive research in order to clarify or extend certain procedural and substantive guarantees.
