Autortiesību aizsardzības mehānismi.

Abstract

Autortiesību aizsardzības mehānismi ir noteikti dažādos veidos. Tie tiek regulēti gan privāttiesību līmenī, gan publisko tiesību līmenī. Autortiesību aizsardzība ir vitāli svarīga mūsdienu progresīvajā pasaulē, lai aizsargātu personu intelektuālās un radošās darbības rezultātus, bet autortiesību subjektiem pieejamie aizsardzības mehānismi ir pieejami necentralizēti un dažkārt visefektīvākais tiesību aizsardzības īstenotājs ir privāttiesiskais sektors. Maģistra darba mērķis ir izpētīt dažus autortiesību aizsardzības mehānismus, kas var tikt īstenoti kā preventīvi līdzekļu vai pēc tiesību aizskāruma. Darba rezultātā autors izceļ problēmjautājumu, kas saistīts ar pieejamo autortiesību aizsardzības nepārskatāmību, nepieciešamību personām preventīvi nodrošināt savu autortiesību aizsardzību un nevienprātību termina “autortiesības” un “pavairošanas tiesības” lietošanā. Authors rights protection mechanisms have been identified in different ways. They are regulated both at the level of private law and at the level of public law. Protection of authors rights is vital in today's advanced world in order to protect the results of the intellectual and creative activities of individuals, while the protection mechanisms available to holders of authors rights are open to the uncentralised protection and sometimes the most effective enforcement of rights is the private sector. The aim of the master’s work is to explore some authors rights protection mechanisms that can be implemented as a means of prevention or after an infringement of rights. As a result of the work, the author highlights the issue of the non-transparency of the available copyright protection, the need for persons to proactively ensure their copyright protection and non-compliance in the use of the term “copyright” and “copyright”.
