Testatora griba mantojuma tiesībās tiek uzskatīta par vadošo principu. Gan tiesību zinātnieku vidū, gan arī tiesu praksē ir pausti atšķirīgi viedokļi par testatora spēju paust savu gribu un par testatora patiesās gribas noskaidrošanu, atklājoties mantojumam. Maģistra darba mērķis ir pētīt un analizēt testatora gribas paušanas veidus, kā arī testatora patiesās gribas noskaidrošanas paņēmienus gan zvērinātam notāram, sagatavojot publisku testamentu, gan tiesām, izšķirot strīdus prasības tiesvedības kārtībā. Darba uzdevumi ir izpētīt testatora gribas institūta vēsturisko attīstību, kā arī noskaidrot un salīdzināt mantojuma tiesību pamatprincipus un testatora gribas institūta izpratni, tā piemērošanu citās valstīs – Lietuvā, Igaunijā un Vācijā. Darba rezultātā tiek secināts, ka prasība par testatora spēju paust savu gribu ir atšķirīgi piemērojama privātajiem un publiskajiem testamentiem, taisot publisku testamentu, testators savu gribu var paust dažādos veidos, turklāt personas rīcībspējas ierobežojums, ja persona ir spējīga savu gribu paust, neietekmē personas testamentspēju un nav pamats, lai atteiktu taisīt publisku testamentu. Tiek piedāvāti grozījumi Civillikuma 439., 440., 446. pantā, izslēdzot Civillikuma 442. pantu un Bāriņtiesu likuma 67. panta trešo daļu. The intent of a testator is the main principle in inheritance law. There have been different opinions between scholars and also in court practice regarding the ability of the testator to express his intent and determination of the testator’s true intent upon the opening of the inheritance. The aim of the paper is to explore and analyse the forms in which the testator can express his intent and the methods used in order to determine the testator’s true intent by a sworn notary preparing a public testament and by a court resolving a dispute about the validity of the testament. The following enabling objectives have been set – to explore the historical development of the institute of the testator’s intent, as well as to reveal and compare the fundamental principles, comprehension and application of this institute and its forms in different countries – Lithuania, Estonia and Germany. The conclusions that the requirement of the ability of the testator to express his intent is applied differently in a public and a private testament, as in making the public testament the testator can express his intent in various different forms, furthermore the restrictions on a person’s legal capacity, if the person is able to express his intent, does not affect the person’s testamentary capacity and cannot be a reason to refuse to make the public testament have been drawn. Amendments in Articles 439, 440, 442, 446 of the Civil Law of Latvia and Article 67 of the Law on Orphan’s Courts have been proposed.
