Eiropas Padomes konvencijas par vardarbības pret sievietēm un vardarbību ģimenē novēršanu un apkarošanu analīze un atbilstība Latvijas Republikas Satversmei

Lielākā daļa iebildumu un pieņēmumu par Eiropas Padomes Konvenciju par vardarbības pret sievietēm un vardarbības ģimenē novēršanu un apkarošanu jeb Stambulas konvenciju izriet no tajā iekļautā sociālā dzimuma jēdziena, to skatot sociālās teorijas izpratnē. Darba mērķis ir noteikt Stambulas konvencijas tvērumu un atbilstību Satversmei, tāpēc autore noskaidros konvencijas interpretācijas nosacījumus un robežas, kā arī sociālā dzimuma nozīmi konvencijā. Darba beigās autore ir secinājusi, ka par Stambulas konvenciju izteiktie iebildumi izriet no neprecīzas konvencijas interpretācijas, normas netulkojot tās objekta un mērķa ietvaros. Stambulas konvencijā iekļautais sociālā dzimuma koncepts jau šobrīd darbojas Latvijas tiesību sistēmā, tāpēc konvencija ir uzskatāma par atbilstošu Satversmei. Most of the objections and assumptions regarding the Council of Europe Convention on preventing and combating violence against women and domestic violence or the Istanbul Convention stem from the concept of gender in the sense of social theory. The purpose of this master thesis is to determine the scope of the Istanbul Convention and to study whether it complies with the Constitution of the Republic of Latvia. Therefore, the author will clarify conditions and scope of the interpretation of Istanbul Convention, as well as the role of gender in the Convention. By the end of this paper, the author has concluded that objections to the Istanbul Convention stem from an inaccurate interpretation of the Convention. The terms are not interpreted within the object and purpose of the Convention. The concept of gender contained in the Istanbul Convention already is applicable in the legal system of Latvia, therefore, Convention is considered to be in conformity with the Constitution of Republic of Latvia.
