Darbā tiek pētīts pienācīgā kārtībā pieņemta likuma saturs cilvēka pamattiesību ierobežošanas kontekstā. Lai pilnvērtīgāk izpētītu šo jautājumu, darba ietvaros tiek pētīta ne tikai Latvijas tiesu prakse, bet arī Eiropas Cilvēktiesību tiesas prakse un tās ietekme uz Latvijas pamattiesību ierobežošanas metodoloģiju. Pētījumu rezultātā autore secina, ka Satversmes tiesa, veidojot nacionālo pamattiesību ierobežošanas mehānismu, lielā mērā ir iedvesmojusies no Eiropas Cilvēktiesību tiesas judikatūras, kā arī šobrīd Satversmes tiesa turpina veidot savu tiesu praksi atbilstoši jaunākām Eiropas Cilvēktiesību tiesas atziņām. Izpētot Satversmes tiesas praksi, autore secina, ka Latvijā pamattiesību ierobežojums var tikt noteikts tikai ar pienācīgā kārtībā pieņemtu likumu, proti, ar tādu ārējo normatīvo aktu, kas atbilst augstāka juridiskā spēkā tiesību normām, kas izstrādāts, ievērojot normatīvajos aktos paredzēto kārtību, un kas ir paredzams un pietiekami skaidri formulēts. This paper analyzes the possibility of limitation of fundamental rights on the basis of the national act. For this purpose and for better the understanding of this question this paper researches not only the case law of the Constitutional Court of the Republic of Latvia, but also the case law of the European Court of Human rights. As a result of this research author concludes that the case law of the European Court of Human rights has affected the jurisprudence of the Constitutional Court of the Republic of Latvia in questions concerning the limitations of the fundamental rights. As derives from the case law of the Constitutional Court of the Republic of Latvia, fundamental rights could be limited only on the basis of the legislative act which is in line with the general principles of law and legislative acts of the higher institutions, which is adopted in the lawful legislative procedure and which is sufficiently clear and foreseeable.
