Atbildība par nelikumīgām darbībām sportā

Abstract

Šī darba temats ir atbildība par nelikumīgām darbībām sportā, konkrētāk, par manipulācijām ar sporta sacensībām un antidopinga noteikumu pārkāpumiem, skatoties uz faktu, ka par pirmo Krimināllikumā iekļauts atsevišķs pants, bet par dopinga lietošanu nav un kriminālatbildību iespējams piemērot tikai ļoti retos gadījumos. Tālākai tēmas analīzei būtiski izprast jēdzienu saturu, šo darbību praktisko izpausmi un ietekmi uz sportistu tiesībām, interesēm, kā arī uz sabiedrību kopumā. Bakalaura darba mērķis ir apskatīt minēto neatļauto rīcību aktualitāti Latvijā, regulējumu un tā atbilstību starptautiskajiem tiesību aktiem, kā arī regulējumu ārvalstīs, kurās par manipulācijām ar sporta sacensībām un antidopinga noteikumu pārkāpumu paredzēta kriminālatbildība. Aplūkojot agrākos mēģinājumus papildināt Latvijas tiesību aktus, ārvalstu pieredzes, nepieciešamības novērst dopinga lietošanu, manipulāciju ar sporta sacensībām un antidopinga noteikumu pārkāpumu līdzīgās būtības un radītajām sekām, izdarīti secinājumi par kriminālatbildības noteikšanas vajadzību un izvirzīti priekšlikumi normu izveidei.

The subject of this work is the responsibility for illegal activities in sport, more specifically, the manipulation of sports competitions and anti-doping rules violations, considering the fact that about the first one The Criminal Law of Latvia contains a separate article, but there is no criminal liability for doping it can only be applied in very rare cases. For further analysis of the topic, it is essential to understand the content of the concepts, the practical expression of these activities and the impact on the rights, interests, and the general public of the athletes. The aim of the Bachelor's paper is to examine the topicality of unlawful actions in Latvia, regulation and its compliance with international law, as well as regulation in foreign countries, where criminal liability for manipulation of sports competitions and anti-doping rules is provided. Based on earlier attempts to supplement Latvian legislation, foreign experience, the need to prevent doping, similar nature and consequences of manipulation of sports competitions and anti-doping rule violations conclusions have been drawn on the need for criminal liability. The author has put forward proposals to supplement The Criminal Law.
