Saimnieciskās darbības kritērijs termina "patērētājs" legāldefiznīcijā Latvijā

Abstract

Termina ”patērētājs” legāldefinīcijā ir iestrādāti vairāki kritēriji, lai atpazītu darījumā ekonomiski vājāko pusi. Viens no tiem ir saimnieciskās darbības kritērijs, kura nozīme un izpratne Eiropas Savienības un Latvijas regulējumā tiek skatīta bakalaura darbā. Tāpat bakalaura darbā analizēti jautājumi, kas rodas ar šī kritērija piemērošanu, kā arī sniegts autores skatījums, secinājumi un priekšlikumi. Rezultātā autore nonāk pie secinājuma, ka saimnieciskās darbības kritērijs palīdz atpazīt darījumā ekonomiski vājāko pusi, jo ir nepieciešams nošķirt, kad persona rīkojas saimnieciskās darbības un kad ārpus saimnieciskās darbības ietvariem.

To recognize the economically weaker contractual party of a deal, several criteria have been included into the legal definition of the consumer. One of these criteria is the criterion of economic activity whose meaning and understanding in the European Union and Latvian regulation is explored in bachelor’s paper. There are analysed issues arising from adapting this criterion, as well there are given the view, conclusions and proposals of the author. In a result, the author comes to the conclusion that the criterion of economic activity helps to recognize the economically weaker contractual party of a deal, because it is necessary to seperate when a person acts in the course of an economic activity and when it acts outside the scope of the economic activity.
