Mantas īpašā konfiskācija ir piespiedu ietekmēšanas līdzeklis krimināltiesībās. Šīs konfiskācijas regulējums ir salīdzinoši jauns un nozīmīgs mantisko jautājumu risināšanā krimināllietās, kā arī rada neskaidrības un pretrunīgumu tā piemērošanai praksē. Mantas īpašās konfiskācijas institūta izstrādāšanā, liela loma bija starptautiskajām tiesību tendencēm un starptautisko organizāciju spiedienam cīņā pret noziedzīgos nodarījumos iegūtu vai izmantotu mantu. Darba mērķis ir analizēt normatīvos aktus, juridisko literatūru un tiesu praksi par mantas īpašo konfiskāciju, pētīt tās vēsturisko attīstību un starptautisko regulējumu. Darba uzdevums ir pētīt mantas īpašās konfiskācijas institūtu, piemērošanas praksi un problēmjautājumus, rodot arī priekšlikumus to novēršanai. Special confiscation of property is a coercive measure in the criminal law. The new regulation of special confiscation of property in the criminal law is an important institute in criminal cases, however it makes ambiguity and contradiction of using it in practice. International juridical tendencies and the pressure of international organizations of criminal offences against compulsory alienation of a criminally acquired property had a big part in process of inventing the special confiscation of property. The aim of the work is to research and analyze juridical literature, it’s application in Latvia and other countries, research the history of special confiscation of property in Latvia and in other countries. The assignment of work is to research the institute of special confiscation or property, it’s application in practice in Latvia and find out the questions of problems in the application of the mentioned institute, and to find out solutions of these problems.
