Maģistra darbs studiju programmā „Tiesību zinātnes” izstrādāts par tēmu „Speciālās zināšanas un to izmantošanas problemātika noziedzīgu nodarījumu izmeklēšanā”. Darbs sastāv no ievada, trijām nodaļām, no kurām otrajai nodaļai ir četras apakšnodaļas un trešajai nodaļai ir trīs apakšnodaļas. Speciālās zināšanas ir no juridiskām zināšanām atsevišķi pastāvošas, profesionāli iegūtas, praksē nostiprinātas zināšanas kādā zinātnē, mākslā, tehnikā vai amatniecībā. Šādas zināšanas piemīt atsevišķiem, Kriminālprocesa likumā minētiem kriminālprocesa dalībniekiem. Attīstoties mūsdienīgām tehnoloģijām un metodēm izmeklēšanā, palielinās arī noziedznieku prasmes izdarīt dažāda veida noziegumus, līdz ar to pirmstiesas kriminālprocesā nepietiek ar procesa virzītāja juridiskajām zināšanām. Ir gadījumi, kad kriminālprocesa ietvaros ir jāpieaicina speciālo zināšanu izmantošanas subjekti. Īstenojot mērķi, autore iepazinās ar vēsturisko un šobrīd spēkā esošo kriminālprocesuālo regulējumu, izanalizēja speciālo zināšanu institūta būtību un lomu kriminālprocesā, kā arī pētīja speciālo zināšanu izmantošanas subjektu lomu. Maģistra darba ietvaros autore ierosina grozīt Kriminālprocesa 114.pantu, izslēdzot no tā tulku, kurš apzīmēts, kā procesa virzītāja palīgs, un piešķirot tam speciālo zināšanu subjekta statusu. Tāpat autore ierosina grozīt Kriminālprocesa likuma 169. pantu, mainīt vārdus „medicīnas speciālists” uz „medicīnas eksperts”, jo saskaņā ar Kriminālprocesa likumu, speciālists neveic izmeklēšanas darbības. The master paper consists of the introduction and three chapters, the second of which has four subdevisions and the third one has three subdevisions. The special knowledge is separately existing from the knowledge of law, it is professionally attained, the knowledge of a certain science, art, technics or craft consolidated at practice. The knowledge of this kind is owned by the individuals mentioned in the law of Criminal procedure. Developing modern investigating technologies and methods, criminals’ skills to commit several types of crimes grow, so that during the pre – trial criminal process the person directing the proceedings cannot have only legal knowledge. There are cases when within the criminal process individuals having special knowledge should be envolved. Carrying out the goal, the author got acquainted with the historic and at present being valid regulations of criminal process, made analysis of the essence and role of the special knowledge institution in the criminal process as well as investigated the role of individuals being able to apply special knowledge. Within the Master piece the author suggests to change Article 114 of the Criminal procedure law, excluding interpreter who is characterized as the assistant of the person directing the proceedings and attaching them the status of the individual having special knowledge. The author also proposes to change Article 169 of the Criminal procedure law, to replace the words „the medical specialist” to „the medical expert”- specialist does not perform investigative actions.
