Bērnu personas datu aizsardzības nodrošināšana Vispārīgās datu aizsardzības regulas izpratnē

Abstract

Personas datu aizsardzība, ņemot vērā straujo tehnoloģiju attīstību, aizvien aktuālāka kļūst ikdienas dzīvē. Personas datu aizsardzība būtiskas pārmaiņas piedzīvoja 2018.gadā, kad visā Eiropas Savienībā bija jāpiemēro Eiropas Parlamenta un Padomes Regula (ES) 2016/679 (2016.gada 27.aprīlis) par fizisku personu aizsardzību attiecībā uz personas datu apstrādi un šādu datu brīvu apriti un ar ko atceļ Direktīvu 95/46/EK (Vispārīgā datu aizsardzības regula). Datu apstrādē īpaša uzmanība jāpievērš nepilngadīgai personai. Nepieciešams pievērst uzmanību tam, kādā veidā nepilngadīgais sniedz savu piekrišanu datu apstrādei un, vai bērns ir tiesīgs to darīt vienpersoniski bez vecāku kontroles. Bakalaura darba mērķis ir analizēt bērnu, kā datu subjekta piekrišanas nodrošināšanu, ņemot vērā, ka Latvijā bērns vienpersoniski var sniegt piekrišanu savu personas datu apstrādei no trīspadsmit gadu vecuma. Pētījuma rezultātā autore secināja, ka ir jārod līdzsvars starp tiesībām uz personas datu aizsardzību un vecāku pienākumiem, kas attiecas uz bērnu audzināšanu, kā arī konstatēja, ka ir jāpievērš lielāka vērība, kad datu apstrāde tiek veikta uz piekrišanas pamata. The protection of personal data, is becoming increasingly relevant in everyday life, because of the rapid technological developments. The protection of personal data went significant changes in 2018, when Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). In the processing of data, special attention should be paid to the person under age eighteen. It is necessary to draw attention to the way in which the children gives his or her consent to the processing of the personal data and whether the child is entitled to do so alone without parental control. The aim of the work of the bachelor is to analyse the provision of the consent of the child as a data subject, taking into account that in Latvia the child may single-handedly give consent to the processing of his or her personal data from the age of thirteen. As a result of the study, the author concluded that there was a need to strike a balance between the right to protection of personal data and parental obligations relating to parenting, and founds that more attention should be paid when the data is processed on the basis of consent.
