The author of the bachelor's thesis "Secession as rights of self-determination" examines whether, in international law, the remedial secession, which includes the right of the people to separate from the State in the case of gross violations of human rights, is established as a norm of customary law. The thesis analyzes national case law, as well as, international, regulations and the opinions of international law experts, with particular emphasis on events in Kosovo. It also explains how the remedial secession interacts with the right to self-determination and seemingly contrary principle territorial integrity. It is proved in the thesis that the remedial secession at the present moment in international law has not been established as a customary norm due to lack of the practice of states and opinio juris. In addition, it is concluded that the widely different opinions of the states on this issue and the impact of the policy will probably never be able to secure remedial secession the status of customary norm.
