Šodien noziedzīgi iegūtu līdzekļu legalizācijas problēma Latvijā ir tik kritiska un asa valstiskā līmenī, kā vēl nekad iepriekš. Jau šogad oktobrī valdībai būs jāuzrāda būtiski uzlabojumi NILLTFN jomā Eiropas Padomes noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas ekspertu komitejai Moneyval. Bankas, bez šaubām, ir pakļautas visaugstākajam riskam un reizē arī aizdomām par naudas līdzekļu atmazgāšanu. Darbā ir analizēta Banku sektora problemātika NILLTFN jomā. Autore pēta, kā darbojas un tiek ievēroti tiesiskie mehānismi Bankas ikdienas sadarbībā ar uzraugošām iestādēm un klientiem un šo attiecību trūkumus. Vienlaikus, darba gaitā autore pēta darījuma attiecību ar klientu nodibināšanas procesu, pievēršot īpašu uzmanību klienta identifikācijas procedūrai, padziļinātās analīzes veikšanai, un PNP un PLG statusu īpatnībām, kā arī tiesu prakses analīzei ar mērķi atklāt pastāvošās likuma interpretācijas problēmas un faktorus, kuri rada augstu NILLTFN risku Bankām. Darbā autore arī izskata un piedāvā rekomendācijas un ieteikumus situācijas uzlabošanai. Never before, as today, the problem of money laundering in Latvia was not stated so critical and sharp in front of the country. In October, this year, the government will have to present significant improvements to AML/CTF by the Council of Europe's Committee of Experts on Money Laundering and Terrorist Financing, Moneyval. Banks are undoubtedly exposed to the highest risk and suspicion in money laundering. The bachelor paper is focused on issues of the banking sector in the AML/CTF. The author examines, how the legal mechanisms are functioning and followed up in the Bank's day-to-day cooperation with supervisors and clients, and the shortcomings of these relationships. At the same time, in the course of the paper, the author explores the process of establishing a business relationship with clients, paying special attention to the customer identification procedure, conducting in-depth analysis, and peculiarities of PEP’s and true beneficiary’s status, as well as the analysis of the case law, with the aim of discovering the existing problems of law interpretation, and factors which pose a high AML/CTF risk to the Banks. The author suggests recommendations and guidance for improving the situation.
