LES 50. panta piemērošanas problēmas

Abstract

Bakalaura darbā izpētītas Līguma par Eiropas Savienību 50. pantā nostiprinātas dalībvalstu tiesības izstāties no Eiropas Savienības. Darbā izpētīts, kāda ir izstāšanās procedūra un, analizējot tiesu praksi, izvērtēts kā interpretējama klauzula par dalībvalsts tiesībām izstāties saskaņā ar savām konstitucionālajām prasībām. Empīriskajā daļā autore izvērtē dalībvalsts izstāšanas iespējamos iemeslus un ietekmi uz pašu dalībvalsti, Eiropas Savienību un citām dalībvalstīm, kā arī iespējamos nākotnes sadarbības modeļus. Darbā izpētīti Brexit aktuālie jautājumi un ietekme uz Apvienotās Karalistes, Eiropas Savienības un Latvijas tiesībām. Autore, izpētījusi Eiropas Savienības tiesību aktus un tiesu praksi, secina, ka izstāšanās procedūras tiesisko regulējumu iespējams pilnveidot un darba kopsavilkumā norāda uz iespējamiem risinājumiem.

The Bachelor's paper examines the right of Member States to withdraw from the European Union, enshrined in Article 50 of the Treaty on European Union. The paper examines the withdrawal procedure and analysing case-law evaluates interpretation of the clause on the right of a Member State to withdraw in accordance with its constitutional requirements. In the empirical part, the author evaluates the possible reasons for the withdrawal of a Member State and its impact on the Member State, the European Union and other Member States, as well as possible future models of cooperation. The paper explores Brexit's topical issues and implications for UK, European Union and Latvian law. After studying European Union legislation and case law, the author concludes that the legal framework for the withdrawal procedure can be improved and the summary indicates some possible solutions.
