Promocijas darbs „Personas datu aizsardzības krimināltiesiskie aspekti” ir veltīts privātās dzīves neaizskaramībai attiecībā uz fiziskās personas datu apstrādi un to krimināltiesiskās aizsardzības jautājumiem. Par temata aktualitāti liecina straujā informācijas tehnoloģiju attīstība, kas būtiski ietekmē gan kopumā visu sabiedrību, gan katra atsevišķa indivīda profesionālo, sociālo un personīgo dzīvi. Tehnoloģiskais progress vienlaikus sekmē arī jauna veida noziedzīgu nodarījumu attīstību, kas nopietni skar fizisko personu datu jomu. Tāpēc šis darbs ir aktuāls gan no teorijas, gan arī no krimināltiesību praktiskās piemērošanas viedokļa, it īpaši ņemot vērā to, ka līdz šim Latvijā nav veikti padziļināti pētījumi par fizisko personu datu krimināltiesisko aizsardzību. Šī pētījuma centrālais objekts ir fizisko personas datu aizsardzības normatīvā regulējuma praktiskās piemērošanas un nodarījumu kvalifikācijas problēmas, kas saistītas ar administratīvās atbildības un kriminālatbildības nošķiršanas jautājumiem šajā jomā, kā arī problemātika saistībā ar tādu jauna veida nodarījumu, kā piemēram, identitātes zādzības, attīstību personas datu jomā. Tāpēc darba galvenais mērķis ir noskaidrot visus ar pētījuma objektu saistītos problēmjautājumus un sniegt priekšlikumus to risināšanai un novēršanai. Promocijas darba uzdevumi ir izanalizēt personas datu jēdziena saturu un Krimināllikuma 145. panta sastāvu, aplūkot sabiedrībā valdošos uzskatus par personas datu un sveša noslēpuma aizsardzību, izpētīt personas datu krimināltiesiskās aizsardzības vēsturiskos aspektus, noskaidrot izplatītākos personas datu aizskāruma veidus, kā arī veikt citus ar darba mērķa sasniegšanu saistītos izpētes darbus. Lai pētījums būtu pēc iespējas pilnīgāks un saturīgāks, ir veikts normatīvā regulējuma salīdzinājums ar citām valstīm, noskaidrots personas datu aizsardzības jomā strādājošo ārvalstu speciālistu viedoklis, kā arī analizēta tiesu prakse, Eiropas Cilvēktiesību tiesas un Eiropas Savienības tiesas judikatūra fizisko personu datu aizsardzības jomā. Pēc normatīvās bāzes un tiesu prakses izpētes promocijas darbā ir izteikti priekšlikumi Krimināllikuma papildināšanai ar jaunām normām, attiecīgi piedāvājot šo grozījumu redakcijas. Šajā darbā ietverti arī praktiski ieteikumi, kas varētu palīdzēt darbā ar fizisko personu datu aizsardzības jautājumiem, it sevišķi vērtējot personas datu aizskāruma rezultātā cilvēkam nodarīto kaitējumu. The Doctoral Thesis “The Aspects of Criminal Law in the Personal Data Protection” considers the right to respect for private life regarding the processing of personal data and the issues of criminal-legal protection of personal data processing. Rapid development of information technologies indicates topicality of the theme, which substantially influences entire society overall and the professional, social, and private life of each separate individual. The technological progress simultaneously facilitates also the development of new types of criminal offences, which seriously affect the field of natural person data, therefore this thesis is topical both from the viewpoint of theory and the practical enforcement of criminal law, especially when taking into account that an in-depth study has not been carried out in Latvia on the personal data protection of natural persons through criminal law. The central object of this study is the problems in offence classification and the practical enforcement of the legislative framework of natural person data protection, which are related to the issues of criminal liability separation in this field, and also the problematic in relation to the development of new offences of such types in the field of personal data, for example identity theft The main goal of the Thesis therefore is to clarify all the issues related to the research subject and to provide suggestions for dealing with and eliminating them. The work tasks of Thesis are to analyse the concept’s content and the composition of section 145 in the Criminal Law, considering the opinions on the protection of personal data and secrets of another which exist in the society, examine the historical aspects of the criminal-legal protection of personal data, clarify the most common types of personal data infringement, and also carry out other research work related to achieving the thesis goal. For the research to be as complete and meaningful as possible, the following has been carried out: legislative framework has been compared with other countries, opinion of foreign specialists working in the field of personal data protection has been clarified, case law of the ECHR and EU courts in the field of personal data protection has been analysed. After researching the normative basis and case law, suggestions have been proposed in the Doctoral Thesis to supplement the Criminal Law with new norms, correspondingly offering the wording of these amendments. Practical suggestions have also been included in this Thesis, which could help in the work with the issues of natural person data protection, especially when assessing the harm caused to the person due to the infringement of personal data.
