Maģistra darbā tiek pētīta apelācijas instances tiesā izskatāmo apelācijas lietu apjoma un robežu noteikšana kriminālprocesa ietvaros. Kopā ar to, minētais jautājums tiek izskatīts no normatīvā regulējuma un pastāvošas tiesu prakses skatupunktiem, kā arī tiks sniegta citu valstu normatīvā regulējuma salīdzinoša analīze attiecībā uz apelācijas lietu apjomu un ietvaru noteikšanu. Maģistra darba mērķis ir, ņemot vērā pieejamo kasācijas tiesas tiesu praksi un pastāvošo normatīvo regulējumu, noskaidrot problemātiku krimināllietu izskatīšanas apjoma un ietvaru noteikšanā apelācijas instances tiesā, kā arī konstatēt kopējo tendenci pētāmā jautājuma risināšanai un, ielūkojoties ārvalstu krimināltiesību regulējumā, formulēt secinājumus Kriminālprocesa 562.panta pamērošanā. Maģistra darbā ir norādīta konstatētā problemātika apelācijas instances tiesā iztiesājamo krimināllietu apjoma un to robežu noteikšanā, ka arī ņemot vērā minēto, pausti konkrētie secinājumi regulējošas normas tvēruma apzināšanai. The Master's thesis researches the establishment of the scope and boundaries of the appeal cases tried in the Court of Appeal within the framework of criminal proceedings. Together with this, the topic is examined from the regulatory framework and existing case-law views, in addition to that a comparative analysis of the regulatory framework of other countries is provided in regard to the scope and limits of the appeal cases. The aim of the Master's thesis is to point of the difficulties in determining the scope and boundaries of criminal proceedings in the Court of Appeal taking into account the available case-law of the Court of Cassation and the existing regulatory framework, as well as to establish the common tendency in addressing the topic based on the approach of other countries and to draw the conclusion regards to the application of the Article 562 of the Criminal Procedure. The Master's thesis highlights the difficulties in the determination of the scope and limits of the criminal cases in the Court of Appeal, in addition to the above mentioned specific conclusions are made for the scope identification of the regulatory framework.
