Maģistra darbs “Tiesību uz privātās dzīves neaizskaramības nošķiršana no tiesībām uz personas datu aizsardzību” ir pētījums par to, vai un kā tiesības uz personas datu aizsardzību tiek nošķirtas no tiesībām uz privātās dzīves neaizskaramību un kā tas ietekmē Satversmes 96.panta tvērumu. Maģistra darba aktualitāti pamato 2016.gada 27.aprilī pieņemtā Vispārīgā datu aizsardzības regula, kas, pastiprinot ES Pamattiesību hartas 8.panta darbības jomu, uzliek lielāku konstitucionālo spiedienu ES dalībvalstīm, kur tiesības uz personas datu aizsardzību ir tiesību uz privātās dzīves neaizskaramības satura elements. Maģistra darba mērķis ir izpētīt privātuma un datu aizsardzības jēdzienu, personas datu aizsardzības tiesisko regulējumu un identificēt problēmas šo tiesību nošķiršanas procesā. Pētījuma ietvaros secināts, ka tiesību uz privātās dzīves neaizskaramību un tiesību uz personas datu aizsardzību nošķiršana balstās uz: personu datu apstrādes darbības rezultātā radītā kaitējuma ietekmi uz personas privāto dzīvi; apstrādāto personas datu apjomu un tā saikni ar personas privāto dzīvi. The Master Thesis “Separation between Right to Privacy and the Right to the Protection of Personal Data” is a study on how the right to the protection of personal data is separated from the right to inviolability of private life and how it encroaches on Article 96 of the Constitution of the Republic of Latvia. The topicality of the Master's Thesis is justified by the General Data Protection Regulation adopted on April 27, 2016, which reinforces the scope of Article 8 of the EU Charter of Fundamental Rights, putting greater pressure on the EU Member States, where the right to the protection of personal data is an element of the right to privacy. The aim of the Master's thesis is to study the concept of privacy and data protection, the legal framework for data protection of persons, and to identify problems in the process of legal separation. The study concluded that the separation of the right to privacy and the right to the protection of personal data is based on: the impact of the damage on the private life of a person caused by the processing of personal data; the amount of personal data processed and its relation to the privacy of the person.
