Disciplinārsodu piemērošana ieslodzījuma vietās

Kriminālsoda – brīvības atņemšana – efektīvai realizācijai un resocializācijas procesa nodrošināšanai, notiesātajiem ir jāievēro ieslodzījuma vietas kārtība. Latvijas Sodu izpildes kodeksā noregulēts disciplinārsodu institūts, kas paredz notiesāto atbildību par soda izciešanas režīma pārkāpumiem un ieslodzījuma vietu pienākumu nodrošināt samērīgu disciplinārsoda piemērošanu. Darba mērķis ir izpētīt disciplinārsodu piemērošanas sistēmu, konstatēt nepilnības un ierosināt grozījumus. Darba uzdevumi ir analizēt tiesību aktus, literatūru, tiesu praksi, kā arī apzināt šī brīža situāciju ieslodzījuma vietās. Pētījuma ietvaros autore konstatēja, ka pastāv problemātika disciplinārsoda izvēlē, tādējādi piedāvāja grozījumus normatīvajos aktos un pasākumus pārkāpumu mazināšanai. For the effective implementation of the criminal penalty - deprivation of liberty – and to ensure a successful resocialisation process, convicts have to respect order in prison. The Sentence Execution Code of Latvia regulates the institute of disciplinary sanctions including the liability of convicts for violations and the obligation of prisons to ensure a fair application of sanctions. The aim of the work is to study the system of disciplinary sanctions, to establish flaws and to propose amendments. The tasks of the work are to analyze the legislation, literature, court practice and to identify the current situation in prisons. Within the research, the author found a problem in the choice of disciplinary sanction, thus proposing amendments in legislation and measures to reduce violations.
