Abstract

Autores izraudzītā tēma ir “Atvaļinājumi, to piešķiršanas kārtība”. Darba devēja un darbinieka savstarpējās attiecības vienmēr būs aktuālas, jo, jebkurās attiecībās rodas domstarpības – darba strīdi. Ja likumā nav precīzi definētas tiesību normas, tad pastāv iespēja tās piemērot dažādi. Lai izvairītos no darba strīdiem nepieciešams pēc iespējas precīzāk definēt darba tiesību normas. Darba mērķis: izpētīt Darba likumā noteikto tiesisko regulējumu, konstatēt ar atvaļinājumu piešķiršanu un izmantošanu saistītās problēmas. Darba ietvaros izvirzītie darba uzdevumi: izpētīt atvaļinājumu regulējošos tiesību aktus Latvijā un konstatēt kompensācijas par neizmantoto atvaļinājumu problemātiku. Secinājums: Darba likumā nepieciešams veikt papildinājumus un precizējumus, lai novērstu domstarpību situācijas starp darba devēju un darbinieku.

The theme chosen by the author is “Vacations, Procedures for Granting”. The relationship between the employer and the employee will always be ongoing because, in any relationship there may be a disagreement - labour disputes. If the law does not precisely define legal provisions, it is possible to apply them in different ways. In order to avoid workplace disputes, it is necessary to define the rules of labour law as precisely as possible. Aim of the thesis: to investigate the legal framework of Labour Act, to identify problems related to the granting and use of vacations. Task of thesis: research the legislation regarding vacations in Latvia and identifying the problem of compensation for unused leave. Conclusion: The labour law needs changes and clarification in order to avoid situations of disagreement between the employer ant the employee.
