Adopcijas noslēpuma neizpaušanas ietekme uz bērna tiesiskajām interesēm.

Abstract

Bakalaura darba tēma ir „Adopcijas noslēpuma neizpaušanas ietekme uz bērna tiesiskajām interesēm”. Autore bakalaura darba tēmas izvēlē un izstrādē balstījusies uz to, ka adopcijas noslēpuma regulējums ir pretējs bērna tiesisko interešu principam, kas valstij jānodrošina, izstrādājot un pieņemot normatīvos aktus. Bērna tiesisko interešu ierobežošana, liedzot noskaidrot savu patieso izcelsmi, ir pretēja tam, ko garantē bērna interešu principa būtība. Bakalaura darbā analizēts vairāku valstu regulējums saistība ar adopcijas noslēpumu un no tā izrietošās bērna tiesiskās intereses noskaidrot savu patieso izcelsmi. Bakalaura darba izstrādes mērķi ir veikt padziļinātu izpēti par bērna interešu principa tiesiskuma mijiedarbību ar Latvijas normatīvajos aktos reglamentēto. Bakalaura darbā secināts, ka bērna interešu princips tiesību normās, kas reglamentē adopcijas noslēpuma uzzināšanu, nav ievērots. Autore uzskata, ka ir veiksmīgi realizējusi mērķus, kuru realizācija bija paredzēta bakalaura darba izveides procesā.

The topic of the bachelor’s thesis is „Influence of the secrecy of adoption on the interest of children”. The author has chosen and developed the topic of the bachelor’s thesis based on the fact that the regulation of the secret of adoption is contrary to the principle of children’s legal interests, which the state must ensure when drafting and adopting regulatory enactments. Restriction of child’s legal interests which prevents the child to find out the true origin is contrary to the guaranteed essence of the principle for child’s interests. The bachelor thesis analyzes the regulation of secrecy of the adoption in several countries and the results of the child’s legal interest to have the possibility to find out its true origin. The aim of the bachelor’s theses is to explore and conduct detailed study and analysis of child’s legal interests protection within the regulations of Latvian regulatory enactments. The Bachelor's theses concludes the following fact - that the principle of the best interests of the child to find out its true origin has not been followed and complied with the regulation of the adoption secret. The author believes that with a detailed analysis she has successfully achieved the goal of the bachelor's thesis.
