Pulcēšanās brīvība virtuālajās kopienās

Abstract

Bakalaura darbā “Pulcēšanās brīvība virtuālajās kopienās” sniegts ieskats jautājumos par pulcēšanās brīvības tiesisko regulējumu Latvijas Republikā un starptautiskajās tiesībās, par šo pamattiesību realizēšanas problemātiku tiešsaistē un nepieciešamību radīt jaunu tiesisko regulējumu, kas spētu efektīvāk regulēt personu tiesības uz pulcēšanās brīvību virtuālajās kopienās. Darba mērķis ir atklāt problēmjautājumus, kas saistīti ar pulcēšanās brīvības īstenošanu tiešsaistē, un piedāvāt atbilstošus risinājumus. Attiecīgais jautājums juridiskajā literatūrā līdz šim vēl nav pētīts, taču tā aktualitāti apstiprina praksē radušās problēmsituācijas, kas saistītas ar tiesību uz pulcēšanās brīvību virtuālajās kopienās realizēšanu un ar šīs pamattiesības ierobežojumiem. Pētījuma rezultātā autore konstatē nepieciešamību garantēt un efektīvi aizsargāt personas tiesības uz pulcēšanās brīvību virtuālajās kopienās, faktiskās problēmas pamattiesību īstenošanā, pamattiesību apdraudējumus un piedāvā efektīvākos līdzekļus šo pamattiesību aizsargāšanai.

The bachelor's thesis “Freedom of Assembly in Virtual Communities” provides an insight into the issues of the legal regulation of freedom of assembly in the Republic of Latvia and international law, on the exercise of these fundamental rights online and the need for a new legal framework capable of regulating more effectively the right of individuals to freedom of assembly in virtual communities. The aim of the work is to identify problems related to the implementation of freedom of assembly online and to propose appropriate solutions. The relevant issue has not been studied in the legal literature so far, but its topicality is confirmed by problematic situations arising in practice, related to the exercise of the right to freedom of assembly in virtual communities and restrictions on this fundamental right. As a result of the research, the author finds the need to guarantee and effectively protect a person's right to freedom of assembly in virtual communities, actual problems in the implementation of fundamental rights, threats to fundamental rights and offers the most effective means of protecting these fundamental rights.
