Kompensācijas apmērs par noziedzīga nodarījuma radīto morālo aizskārumu

Bakalaura darba mērķis ir izpētīt ar noziedzīgu nodarījumu radīta morālā aizskāruma kompensācijas apmēra noteikšanu. Darbā apskatīti kompensācijas par morālo aizskārumu teorētiskie aspekti, kā arī to piemērošana praksē. Lai labāk izprastu, kā šobrīd Latvijā tiek noteiktas kompensācijas par morālo aizskārumu, pētīti jaunākie tiesu spriedumi lietās par noziedzīgiem nodarījumiem pret personas dzīvību un veselību. Rezultāti liecina, ka Latvijas tiesu praksē pastāv atšķirīgas pieejas kompensācijas apmēra noteikšanai, kā arī, ka kompensāciju apmēri kopumā ir salīdzinoši zemi un nav būtiski palielinājušies gadu gaitā, uzlabojoties ekonomiskajai situācijai. Darbā piedāvātas arī kompensācijas apmēru summas, kādas tiesas varētu noteikt šobrīd. The aim of the work of the bachelor is to investigate the determination of the amount of compensation for moral damage caused by criminal offence. This work deals with theoretical aspects of the compensation for moral damage and their application in practice. In order to better understand how compensation for moral damage is currently being determined in Latvia, the latest judical judgments have been investigated in cases of criminam offences against the life and health of a person. The results show that there are divergent approaches in Latvian case-law to determine the amount of compensation, as well as that compensation amounts are relatively low overall and have not increased significantly over the years as the economic situation improves. In the work also the extents of compensation that the courts could set for now are offered.
