Preču zīmes reģistrācija ir viens no veidiem, ar kuru personas var aizsargāt savas preces un pakalpojumus. Neskatoties uz augsto interesi par preču zīmēm, to pieteicējiem un īpašniekiem Latvijā joprojām rodas problēmas ar preču zīmes atšķirtspējas un ar to saistīto jautājumu izpratni. Šādas problēmas praksē bieži vien noved pie preču zīmes reģistrācijas atteikšanas, atzīšanas par spēkā neesošu vai atcelšanas, šādi traucējot sekmīgu uzņēmējdarbības attīstību. Lai risinātu minēto problēmu, šajā darbā tika noteikti un apkopoti priekšnoteikumi, lai preču zīme iegūtu atšķirtspēju, un gadījumi, kuros preču zīme atšķirtspēju zaudē. Tāpat tika meklētas iespējas, kā uzlabot spēkā esošo preču zīmju tiesisko regulējumu atšķirtspējas jautājumā, lai efektīvāk tiktu sasniegti attiecīgo tiesību normu mērķi. Trademark registration is one of the ways in which persons can protect their goods and services. Despite the high interest in trademarks, their applicants and owners in Latvia still have problems with the understanding of trademark distinctiveness and related issues. In practice, such problems often lead to the refusal, invalidity or revocation of the registration of a trademark, thus hindering the successful development of the business. In order to solve this problem, in this work the preconditions for the trademark to acquire distinctive character and the cases in which the trademark loses distinctive character were identified and summarized. The author also tried to find the ways how to improve the existing trademark legal framework in order to achieve the objectives of the relevant legal norms more effectively.
