Starplēmuma un administratīvā akta nošķiršanas nozīmīgumu var pamatot ar faktu, ka starplēmums nav pārsūdzams atsevišķi no administratīvā akta. Bakalaura darba mērķis ir izpētīt un analizēt būtiskākās atšķirības starp starplēmumu un administratīvo aktu, kā arī noskaidrot tiesu praksē pastāvošo nošķiršanas problemātiku un nošķiršanas dažādību. Darba uzdevumi ir apzināt gadījumus, kad starplēmums ir un kad nav uzskatāms par administratīvo aktu, noskaidrot starplēmuma apstrīdēšanas un pārsūdzības iespējas atsevišķi no administratīvā akta un izpētīt sūdzības kārtības institūtu. Bakalaura darba rezultātā autore secina, ka tiesu praksē pastāv neviennozīmīga izpratne par atsevišķu lēmumu tiesisko dabu, kā arī norāda uz nepieciešamību paplašināt iespējas pārbaudīt starplēmumu tiesiskumu atsevišķi no administratīvā akta. The importance of distinguishing between a pre-decision and an administrative act can be justified by the fact that the pre-decision cannot be appealed separately from the administrative act. The aim of the bachelor's thesis is to explore and analyze the most important differences between the pre-decision and the administrative act, as well as to find out the problems of separation and the diversity of separation existing in court practice. The tasks are to identify the cases when the pre-decision is and when it is not considered an administrative act, as well as to study the possibilities of appealing the pre-decision separately from the administrative act and to explore the institute of complaint procedure. As a result of the bachelor's thesis, the author concludes that in court practice there is an ambiguous understanding of the legal nature of certain decisions. Author also emphasizes the necessity of expanding the possibilities to check the legitimacy of the pre-decision separately from the administrative act.
