Promocijas darba „Programmatūras civiltiesiskās apgrozības tiesiskie aspekti” anotācija

Promocijas darbs ir vērsts uz programmatūras civiltiesiskās apgrozības problemātikas analīzi un attiecīgā Latvijas normatīvā regulējuma pilnveidošanu.
Darbā pētīta datorprogrammas kā autortiesību darba aizsardzība, apskatot tās atbilsmi literāra darba jēdzienam un vērtējot tās eventuālo elementu piederību datorprogrammas jēdzienam datorprogrammas funkcionāli orientētās izpratnes aspektā. Tāpat darbā ir vērtēta autorības problemātika kontekstā ar datorprogrammas autortiesiskās aizsardzības mērķi – datorprogrammas izstrādē ieguldīto investīciju aizsardzību. Papildus tam vērtēts datorprogrammas tiesiskās aizsardzības tvērums, apskatot gan uz to attiecināmās tiesības, gan tiesību ierobežojumus. Visbeidzot, darbā ir vērtēta programmatūras civiltiesiskajā apgrozībā izmantojamo līgumtiesisko instrumentu izmantošanas problemātika. The given thesis analyses the complexity of the civil turnover of software and the opportunities to improve the relevant law of the Republic of Latvia.
The thesis examines computer programs as works protected by copyright by considering their compliance with the notion of a literary work, on the one hand, and evaluating whether the notion of computer program applies to its potential elements, on the other hand, by analysing their conformity to the functionally-oriented meaning of computer program. The thesis also studies the authorship of computer programs in the context of the aim of their protection by copyright – the protection of investments made in creation of computer programs. Furthermore, the scope of legal protection of computer program as the subject matter of the law is analysed, reviewing rights and limitations of rights applicable to computer programs. Lastly, the thesis addresses the problem of contractual instruments used in the civil turnover of computer programs.
