Instrumenti sabiedrības ietekmei uz likumdevēju tiesiskā demokrātiskā valstī

Abstract

Maģistra darba tēma ir „Instrumenti sabiedrības ietekmei uz likumdevēju tiesiskā demokrātiskā valstī”. Lai sabiedrība varētu izveidot valsti, kurā tā gribētu dzīvot, sabiedrībai ir svarīgi apzināties tās iespējas un pieejamos instrumentus likumdevēja ietekmēšanai. Darba mērķis ir noskaidrot, kas ir sabiedrība likumdošanas kontekstā, tās esošos instrumentus un to izpausmes ietekmei uz likumdevēju tiesiskā demokrātiskā valstī, instrumentu efektivitāti un piemērošanas sekas, kā arī uz konkrēta gadījuma piemēra analizēt cik ilgā laikā un kādai sabiedrības grupai izdevās realizēt pastāvošas kārtības maiņu. Darba uzdevumi ir analizēt demokrātiskās valsts iekārtas būtību un tās izpausmi, likumdošanas varas uzbūvi un funkcijas, definēt sabiedrības jēdzienu likumdošanas kontekstā, apkopot sabiedrības ietekmēšanas instrumentus uz likumdevēju, noskaidrot to efektivitāti un pielietošanas sekas, kā arī pēc konkrēta gadījuma piemēra analizēt, ar kādiem instrumentiem, cik ilgā laikā un kāda sabiedrības daļa realizēja savu gribu. Darba rezultāti norāda uz to, ka sabiedrība likumdošanas kontekstā ir aktīvo sabiedrības vienību interešu grupas, kuras, izmantojot dažādus instrumentus, cenšas panākt savu interešu ievērošanu likumdošanas procesā. Apkopojot instrumentus, ar kuriem sabiedrība var ietekmēt likumdevēju, autore izdalīja tādus mehānismus kā priekšstāvju likumdošanas orgānā ievēlēšana un atsaukšana, tautas nobalsošana, likumdošanas iniciatīvas tiesības, kolektīvais iesniegums, nevalstisko organizāciju līdzdarbošanās likumdošanas procesā, sapulces, gājieni un piketi, mediji un sociālie tīkli. Savukārt pēc darbā apskatītā gadījuma piemēra, autore secināja, ka sabiedrība caur dažādu instrumentu izmantošanu var mainīt pastāvošu kārtību divu gadu laikā. Maģistra darba apjoms ir 80 lappuses.

The topic of the master's thesis is “Instruments for public influence on the legislation in a legitimate democratic state”. In order for a society to be able to create a country in which it would like to live, it is important for the society to be aware of its possibilities and available tools for influencing the legislator. The aim of the work is to find out what society is in the context of legislation, its existing instruments and their manifestations on the legislator in a democratic state, their effectiveness and consequences, as well as to analyze how long and which societies groups managed to realize its will. The tasks are to analyze the essence of a democratic state governed by the rule of law, the structure and functions of the legislature, to define the concept of society in the legislative context, to summarize the tools of influencing the legislator, to determine their effectiveness and consequences, as well as the society exercised their will. The results of the work indicate that the society in the context of legislation is the interest groups of active units of society, which, by using various instruments, try to achieve the observance of their interests in the legislative process. In summarizing the tools by which the public can influence the legislature, the author singled out mechanisms such as the election and removal of representatives in the legislature, referendums, the right of legislative initiative, collective submission, participation of non-governmental organizations in the legislative process, meetings, marches and pickets, media and social networks. On the example of the case considered in the work, the author concluded that the society can change the existing procedure within two years through the use of various tools. The volume of the master's thesis is 80 pages.
