Maģistra darbs veltīts saistību dzēšanas teorētisko un praktisko aspektu izpētei un analīzei gan Latvijas, gan ārvalstu normatīvajā regulējumā, vienlaikus izvērtējot iespēju parādniekam caur saistību dzēšanu iegūt jaunas ekonomiskās dzīves sākumu. Saistību dzēšana kā fiziskās personas maksātnespējas procesa gala rezultāts ietekmē daudzu parādnieku turpmākās dzīves, tomēr autore darbā ir kritiski vērtējusi apgalvojumu, ka saistību dzēšana garantē parādniekam jaunu sākumu šī jēdziena plašākajā izpratnē. Darba ietvaros tika noskaidrots, ka saistību dzēšana ir tikai viens no jauna sākuma koncepta elementiem, savukārt pilnīgākai šī koncepta izpratnei un īstenošanai praksē ir jāpievēršas arī citiem elementiem, tai skaitā, situācijai pēc maksātnespējas procesa izbeigšanas. Turklāt saistību dzēšanas un jauna sākuma sasniegšanas iespējas parādniekam tiek limitētas, pastāvot neviennozīmīgai tiesu praksei, kas tika konstatēta pētījuma laikā veiktās tiesu prakses analīzes rezultātā. The Master's thesis is devoted to the study and analysis of theoretical and practical aspects of debt discharge in both Latvian and foreign regulatory frameworks, while assessing the possibility for a debtor to obtain a fresh economic start through debt discharge. The debt discharge as the final result of an insolvency proceeding of a natural person affects the future lives of many debtors, however, the author criticized in the study the assertion that the debt discharge guarantees the debtor a fresh start in the broadest sense of this term. Within the framework of the study it was found that debt discharge is only one element of the fresh start concept, and in order to gain a more complete understanding and implementation of this concept it is necessary to focus on other elements as well, including the situation after insolvency process. In addition, the debtor's chances of debt discharge and ability to gain a fresh start are limited due to the inconsistent case law that has been identified as a result of the analysis of case law during the study.
