Maģistra darbā tiek pētīts nosacītas pirmstermiņa atbrīvošanas no soda institūts, Krimināllikuma 61. un 611 panta priekšnoteikumu praktiskā piemērošana vienveidīgas prakses izveidei, kā arī ārvalstu regulējums. Darba mērķis ir analizēt priekšnoteikumus nosacītai pirmstermiņa atbrīvošanai no soda, analizējot normatīvo regulējumu un tiesu praksi, sniegt iespējamos risinājumus vienveidīgas tiesu prakses izveidei, atrisinot problēmjautājumus, kas rodas teoriju piemērojot praksē. Maģistra darbā tiek ieteikts grozīt un konkretizēt nosacītas pirmstermiņa atbrīvošanas ierosinājuma izskatīšanas tiesā termiņus, kā arī iespēju pārsūdzēt tiesas lēmumu pēc būtības. Tāpat darba autore sniedz pamatojumu tiesu prakses apkopojuma izveidei. Atslēgvārdi: nosacīta pirmstermiņa atbrīvošana no soda; elektroniskā uzraudzība; resocializācijas rezultāts; pamats uzskatīt The Master thesis studies the institute of conditional early release from punishment (the parole), the practical application of the preconditions of Articles 61 and 611 of the Criminal Law for the establishment of uniform practice, as well as foreign regulation. The aim of the Master thesis is to analyse the preconditions for parole, analysing the regulatory framework and court practice, to provide possible solutions for the development of uniform court practice, solving the problems that arise when applying the theory in practice. The author recommends to amend and specify the deadlines for the review of a proposal for parole in court, as well as the possibility to appeal the decision of the court on the merits and also provides a justification for the compilation of a compilation of court practice.
