Problems of user’s consent to the privacy policy

Zusammenfassung
The purpose of the thesis is to identify the problems of the acceptance of the privacy policies by users of the online services. The author proposes that there are two types of consent to the privacy policy which are given by the same act of acceptance of the provisions of the privacy policy. The first type of consent is consent to the processing of personal data. This consent shall be in compliance with provisions of the GDPR. The second consent is consent to the rest of the provisions of the privacy policy. This consent may create a binding agreement for the user. In order to prove this assumption, the provisions of the privacy policies of Google, Microsoft, Likedin, Facebook and Apple were analysed. The analysis has shown that the provisions of the privacy policies might be considered as violating the provisions of the GDPR. Also, provisions of the privacy policies are structured in a way to be able to create binding obligations for the user, or at least to create an illusion of the existence of such obligations.
