Zusammenfassung
Bakalaura darbā “Lietošanā esošās zemes platības un robežu noteikšana piespiedu nomas tiesiskajās attiecībās” tiek apskatīts tiesiskais regulējums, kādā noteikta funkcionāli nepieciešamā zemes gabala platība piespiedu nomas tiesiskajās attiecībās. Darba mērķis ir apskatīt tiesisko regulējumu un tiesu praksi, kas nosaka lietošanā esošās zemes platības un robežu noteikšanu piespiedu nomas tiesiskajās attiecībās un, balstoties uz veikto analīzi, izteikt priekšlikumus tiesiskā regulējuma uzlabošanai. Darbā tiek apskatīts tiesiskais regulējums, kas dažādos laika posmos nosaka lietošanā esošās zemes platības un robežu noteikšanu. Darbā tiek aplūkota tiesu prakse un iestāžu pieņemtie lēmumi, nosakot lietošanā esošās zemes platību un robežas, kā arī tiek analizēta tiesiskā regulējuma ietekme uz piespiedu nomas subjektiem, un to interešu aizsardzība. The bachelor's thesis “Determination of the area of land in use and boundaries in the legal relations of compulsory lease” examines the legal regulation which determines the functionally necessary area of the land plot in the legal relations of a compulsory lease. The aim of the thesis is to review the legal framework and case law, which determines the area of land and boundaries in use in the legal relations of a compulsory lease. Furthermore, based on the analysis, the author makes proposals for the improvement of the legal framework. The bachelor’s thesis analyses legal regulations which in different periods determined the land in use and boundaries in the legal relations of a compulsory lease. Moreover, the author analyses judicial practice and decisions made by institutions determining the area and boundaries of the land in use, along with the impact of the legal regulation on the subjects of compulsory lease and the protection of their interests.
