Publiskas personas pārveide par kapitālsabiedrību: ostu piemērs

Abstract

Maģistra darbs “Publiskas personas pārveide par kapitālsabiedrību: ostu piemērs” ir uzrakstīts Latvijas Universitātes Juridiskās fakultātes Valststiesību zinātņu katedrā. Autors darbā ir izpētījis normatīvos aktus un tiesu praksi publiskas personas tiesībām veikt komercdarbību, t.s, caur līdzdalību kapitālsabiedrībās. Apskatīti Latvijas ostu darbības principi, pārvaldības kārtība, analizētas ostu funkcijas privāto un publisko tiesību jomā, kā arī apskatīta ārvalstu prakse ostu pārvaldībā. Darba noslēgumā autors izpētījis pārvaldības juridiskās formas maiņu Ventspils ostā, norādot uz problēmām un ieguvumiem. Noslēgumā secināts, ka ostu komercializācija ir starptautiski izplatīta prakse, kas nodrošina profesionālāku ostas pārvaldību, samazina politisko ietekmi un veicina ostu attīstību.

Master's paper “Transformation of a public person into a capital company: Port example” was written in the Department of Constitutional and Administrative Law, Faculty of Law, University of Latvia. Within the framework of the paper, the author investigates the legal acts and case law on the rights of a public person to conduct commercial, including through in order to find out the legal basis for the participation in capital companies. The paper examines the principles of operation of Latvian ports, management procedures, analyses the functions of ports in the field of private and public law, looked at the foreign port management practices. At the end of the paper, the author has analysed the transformation of the legal form of management in Free Port of Ventspils, pointing out the problems and benefits. It is concluded that the commercialization of ports is an internationally widespread practice that ensures more professional port management, reduces political influence and promotes port development.
