Īpašuma tiesības ir dažādos veidos ierobežotas. Viens no mūsdienās aktuāliem īpašuma tiesības ierobežojumiem ir īpašuma atsavināšana sabiedrības vajadzībām. Bakalaura darbā veikts pētījums par nekustamā īpašuma atsavināšanu sabiedrības vajadzībām. Pētījuma mērķis ir analizēt tiesības uz īpašumu aizsardzību un ierobežojumus, analizēt šī brīža nekustamā īpašuma atsavināšanas tiesiskā regulējuma efektivitāti, pētot to kopsakarā ar aktuālu tiesu praksi, kā arī taisnīgas atlīdzības jēdzienu. Pētījuma rezultāti norāda uz tiesiskā regulējuma trūkumiem un autore piedāvā priekšlikumus par nepieciešamiem grozījumiem tiesību normās. Property rights are restricted in various ways. One of the nowadays popular form of restrictions is expropriation of property for public needs. Bachelor thesis investigate expropriation of immovable property for public needs. The study aims to determine rights to protect property and restrictions related to that, explore the effectiveness of the legal rules relating to the expropriation examining it in connection with current judicature practice, analyse the concept of fair compensation. The results of the research indicate the shortcomings of the legal framework and the author proposes amendments to the existing legal regulations (The author identified shortcomings in the legal framework and proposes amendments to the existing legal regulations).
