Bakalaura darba temats ir “Tiesas kompetence apsūdzības izvērtēšanā”. Tiesas kompetence šajā jautājumā nav izsmeļoši un viennozīmīgi regulēta. Līdz ar to darba mērķis ir izpētīt Latvijas Republikas tiesisko regulējumu attiecībā uz tiesas kompetenci dot novērtējumu izvirzītajai apsūdzībai, tai skaitā tās tiesības pašai iegūt pierādījumus, konstatēt no apsūdzības atšķirīgus faktiskos apstākļus, kā arī atšķirīgu juridisko kvalifikāciju. Darbā tika pētītas tiesas spriešanas un apsūdzības funkcijas, kā arī apsūdzības grozīšana, tās iespējamie trūkumi un to novēršana. Darba rezultātā autore ir nonākusi pie secinājumiem par regulējuma nepilnībām, kā arī sniegusi priekšlikumus tā uzlabošanai. The topic of the bachelor's thesis is “The court’s jurisdiction to assess the indictment”. The jurisdiction of the court in this matter is not exhaustively and unequivocally regulated. Thus, the aim of the bachelor's thesis is to study the legal regulation of the Republic of Latvia regarding the court's jurisdiction to assess the indictment, including its right to obtain evidence, to establish different factual circumstances from the indictment, as well as different legal qualification. The functions of court adjudication and prosecution, as well as the amendment of the indictment, its possible flaws and their prevention were considered in the thesis. As a result of the work, the author has come to conclusions about the shortcomings of the regulation, as well as provided suggestions for its improvement.
