Kukuļņemšana

Abstract

Bakalaura darba tēma ir “Kukuļņemšana.” Darba ietvaros autore pētīs Krimināllikuma 320. pantā ietvertā noziedzīgā nodarījuma sastāvu un ar to saistītos kvalifikācijas un norobežošanas jautājumus, kā arī salīdzinās Latvijas un citu valstu kukuļņemšanas regulējumu. Darba mērķis ir izanalizēt kukuļņemšanas sastāvu un kvalifikācijas problēmas, norobežot to no līdzīgiem noziedzīgiem nodarījumiem, kā arī salīdzināt Latvijas un ārvalstu krimināltiesisko regulējumu. Lai sasniegtu bakalaura darba mērķi autore izvirzīs sekojošus uzdevumus: veikt kukuļņemšanas sastāva analīzi, izanalizēt kvalifikācijas un norobežošanas jautājumus, salīdzināt Latvijas, Lietuvas, Igaunijas, Šveices, Vācijas un Austrijas kukuļņemšanas krimināltiesiskos regulējumus. Darba gaitā autore izdarīs secinājumus atbilstoši šī darba mērķim.

The subject of the Bachelor's thesis is “Bribery.”As part of the thesis, the author will study and look at the composition of the criminal offence covered by Article 320 of the Criminal Law and the related offence skills and demarcation problems, as well as comparison between Latvia and other countries bribing regulation. The objective of the thesis is to analyse the composition of the bribing and the qualification problems, demarcate it from similar criminal offences, as well as to compare the criminal regulation in Latvia and foreign countries. In order to achieve the objective of Bachelor's thesis, the author will set out the following tasks: analysis of the composition of the criminal offence of bribery, analysis of qualifications and demarcation issues, comparison between Latvia and Lithuania, Estonia, Switzerland, Germany and Austria. In the course of the thesis, the author will draw conclusions in line with the objective.
