Vācijas Federālā Konstitucionālā tiesa ar 2020. gada 5. maija spriedumu pirmo reizi vēsturē atzina, ka Eiropas Savienības tiesa ir rīkojusies ultra vires. Lai arī tā nav pirmā reize, kad citas dalībvalstis tā ir rīkojušās, šis ir īpašs gadījums, ņemot vērā Vācijas Federālās Konstitucionālās tiesas lielo ietekmi, sprieduma aso argumentāciju un ekonomiskos apstākļus. Tas iezīmēs jaunu posmu dalībvalstu un Eiropas Savienības tiesas attiecībās un ES tiesību pārākumam. Bakalaura darba mērķis ir sniegt vispusīgu pētījumu un analīzi par Eiropas Savienības tiesību pārākuma principu mijiedarbībā ar nacionālajām konstitūcijām. Tā rezultātā ir izdarīti secinājumi par ES tiesību pārākuma lomu, dalībvalstu tiesu praksi par to un novērtēta Vācijas Federālā Konstitucionālās tiesas 2020. gada 5. maija sprieduma ietekme. German Federal Constitutional Court by its judgment of 5 May 2020, the for the first time in the history stated that the Court of Justice of the European Union had acted ultra vires. Although this is not the first time that other Member States have done so, this is a special case given the strong influence of the German Federal Constitutional Court, the sharp reasoning of the judgment and the economic circumstances. This will mark a new stage in the relationship between the courts of the Member States and the European Union and the supremacy of EU law. The aim of the bachelor's thesis is to provide a comprehensive study and analysis of the principle of the supremacy of European Union law in interaction with the national constitutions. As a result, conclusions have been drawn on the role of the primacy of EU law, the case law of the Member States on it and the impact of the judgment of the German Federal Constitutional Court of 5 May 2020 has been assessed.
