Bakalaura darbā “Šaubu jēdziena izpratne, saturs un nozīme juridiskajā diskursā” veikts pētījums par juridiskajā diskursā lietotā šaubu jēdziena izcelsmi, izpratni, saturu un pielietojumu no vēsturiskā, lingvistiskā, filozofiskā, tiesību teorētiskā un praktiskā aspekta. Pētījumā ir analizēti romiešu un viduslaiku tiesību vēstures posmi, īpašu uzmanību pievēršot kanoniskajām tiesībām un secinot, ka šaubu jēdziens ir evolucionējis no ordāliju procedūrām par tiesnešu morālā komforta institūtu ar izteikti kristīgu mērķi līdz pierādīšanas standartam un apsūdzētā tiesību ievērošanas principam. Juridiskajā diskursā lietotā termina izpratnē noderīgi secinājumi gūti caur filozofisko domāšanu, kur īpaša nozīme ir franču filozofa Renē Dekarta šaubu metodei. Šaubas rodas izziņas procesā, cenšoties atšķirt patieso no aplamā. Šaubas tiesiskajā sistēmā ir šaurākas, nekā pieļauj filozofiskā doma. Latvijas tiesiskajā sistēmā ne vien procesuālajās, bet arī materiālajās tiesībās pastāv gan saprātīgas, gan pamatotas šaubas, un pētījuma centrālais jautājums ir par atšķirību starp šaubu pavadošo apzīmētāju lietojumu Latvijas tiesiskajā sistēmā. Darbā ir secināts, ka “saprātīgs” un “pamatots” nav sinonīmi, tādēļ ir ieteicama terminu grozīšana, lai labāk atspoguļotu to būtību. Likums ne velti nosaka pierādīšanas standartu ārpus “saprātīgām” šaubām, nevis “visām” vai “jebkurām”. Autore izsaka priekšlikumu, ka Latvijas tiesiskajā sistēmā būtu starp diviem jāizvēlas viens šaubu pavadošais apzīmētājs. Autore piedāvā šo izvēli izdarīt par labu “saprātīgām šaubām”, paredzot, ka tas ir plašāks jēdziens, kas vienlaikus sevī ietver arī “pamatotas šaubas”. Autores secinājumu esence ir izsakāma inovatīvā jēdzieniskā kompleksā – “saprātīgi pamatotas šaubas”. The study analyses the stages of the history of Roman and medieval law, with special emphasis on canon rights and concluding that the concept of doubt has evolved from the ordeal procedures as the institute of moral comfort for judges and jury with a highly Christian goal to the standard of proof and the principle of respect for the rights of the accused. In finding the purpose of the term used in legal discourse, useful conclusions have been drawn through philosophical thinking, where the method of doubt created by French philosopher René Descartes is of particular importance. Doubts arise in the inquiry process, trying to distinguish between true and false. Doubts in the legal system are narrower than the philosophical idea allows. In the legal system of Latvia, there are both reasonable and reasoned doubts, not only in procedural, but also substantive law, and the central issue of the study is the distinction between “reasonable” and “well-founded” doubts in the Latvian legal system. The work concluded that “reasonable” and “well-founded” are not synonyms and therefore the modification of terms is recommended to better reflect their substance. The law intentionally determines the standard of proof beyond “reasonable” doubts, not “all” or “any”. The author expresses a proposal that the legal system of Latvia should distinguish between two of the attributed adjectives of doubt. The author proposes that the choice should be made in favour of “reasonable doubt”, providing that it is a broader concept, which also includes “well-founded doubt”. The essence of the author's findings is to be expressed in an innovative conceptual complex – “reasonably reasoned doubts”.
