Latvijas Republikas Covid 19 ierobežojumu atbilstība LESD 45. pantam par darba ņēmēju pārvietošanās brīvību

Abstract

Bakalaura darba tēma ir Latvijas Republikas Covid-19 ierobežojumu atbilstība LESD 45.pantam par darba ņēmēju pārvietošanās brīvību. Pētījuma mērķis ir noskaidrot, kuri Covid-19 ierobežojumi nesamērīgi ierobežo darbinieku pārvietošanās brīvību darba pienākumu izpildē un neatbilst LESD 45.pantam. Darba uzdevums ir izvērtēt ierobežojumus saskaņā ar diskriminācijas un nediskriminējošu ierobežojumu aizlieguma, samērīguma un piesardzības principu, kā arī izteikt ieteikumus nesamērīgo ierobežojumu novēršanai, samērīgi līdzsvarojot indivīda tiesības un sabiedrības intereses. Darbā secināts, ka darba ņēmēju brīvas kustības ierobežojumiem sabiedrības veselības apsvērumu dēļ jābūt tādiem, kas nepieciešamību ierobežot vīrusa Covid-19 izplatību līdzsvaro ar nepieciešamību nodrošināt sabiedrības ilgtspējīgu ekonomisko attīstītu. The topic of the research is the compliance of the Covid-19 restrictions of the Republic of Latvia with the Article 45 of TFEU on freedom of movement for workers. The aim of the research is to find out disproportionate restrictions. The task of the research is to evaluate restrictions in accordance with the principles of prohibition of discrimination and non-discriminatory restrictions, proportionality and precaution, as well as to make recommendations for the elimination of disproportionate restrictions, taking in to account the balance between the rights of the individual and the interests of society. The research concludes that restrictions on the free movement of workers for public health reasons must be such as to balance the need to limit the spread of the Covid-19 virus with the need to ensure the sustainable economic development of society. The research contains 68 pages.
