Atbildības par personas spīdzināšanu raksturojums krimināltiesībās

Abstract

Bakalaura darba “Atbildības par personas spīdzināšanu raksturojums krimināltiesībās” mērķis ir aplūkot spīdzināšanas jēdziena raksturojumu Latvijas Republikas un starptautiskajos tiesību avotos, izpētīt atbildību par spīdzināšanu Krimināllikumā, kā arī noskaidrot spīdzināšanas esību ieslodzījumu vietās. Atbildības par spīdzināšanu problemātika ir saistīta ar apstākli, ka, neskatoties uz to, ka ir ļoti plašs tiesību avotu klāsts, kas regulē daudzus spīdzināšanas aspektus, tāpat ar spīdzināšanu var saskarties. Darba ietvaros tiks apskatīta gan Latvijas, gan ārvalstu tiesu prakse caur Eiropas Cilvēktiesību tiesas spriedumiem, lai identificētu galvenos problēmjautājumus noziegumos, kas saistīti ar spīdzināšanu. Darba izstrādes rezultātā tiks visaptveroši konstatētas problēmas atbildības par spīdzināšanu piemērošanā, piedāvāti risinājumi un atziņas par faktiskās situācijas uzlabošanu.

The aim of Bachelor thesis “Characteristics of liability for torture of a person in criminal law” is contemplate the description of the concept of torture in Latvian Republic and international resources, to identify responsibility for torture in the Criminal law, as well as to find out the existence of torture in prisons. The issue of liability for torture is linked to the fact that, although there is a very wide range of sources of law governing many aspects of torture, torture is still encountered. Within the work there will be viewed the practice of Latvian and foreign courts through the judgements of the European Court of Human Rights, in order to identify the main problematic issues in crimes related to torture. As a result of the elaboration of the work, the problems in the application of the responsibility for torture will be comprehensively identified, solutions and lessons regarding the improvement of the actual situation will be offered.
